To expect better customer service?

Here for traffic as much as anything else. Without going into too much detail I purchased an item costing over £100 using my credit card in the sale. Said item arrived damaged (beyond use) and I took photos and sent them to customer service within 10 mins of delivery. It was a tracked parcel so they could see it arrived damaged rather than claiming we did it. Interestingly the packaging was not damaged at all.

Email customer service, nothing. Phoned a couple of days later and they said they'd have to pass on to the manufacturer to see if it was a replacement part or replace whole thing. Was a bit sceptical but..

Heard nothing for a week so thought time to email again. Reiterated what they'd said on phone and asked what manufacturer had said. Nothing again.

Today is the day I phone to chase up. AIBU to say they send me a new replacement, collect the damaged one and sort it out with the manufacturer themselves? I have had a Google but I'd be there all day trying to weed out the out of date and unrelated stuff to find specifically what I want so thought I'd pick the collective brain here instead. From what I've read I think I'm right that I can but I want to be as sure as possible. Don't want to give the person on the phone a hard time at all, it's not their fault, but I do want what I've purchased so want to present a solid case to them rather than getting fobbed off.

Of course YANBU. What the manufacturer says is irrelevant, your contract is with the seller. Hope you get it sorted.

You are definitely entitled to either a refund or a replacement if the item arrived damaged. Well done for taking pictures and contacting them immediately. I would have done the same. Can I ask what it was and what company you bought it from? X

Why didn't you return it as soon as you seen it was damaged? Most companies will include a packing slip with their returns procedure printed on it.

@zerofuchsgiven good Q, it was an item within a package and the cost to return the lot would have been astronomical even though they would have had to refund it eventually. To be honest when I contacted them I assumed they would just offer to do the logical thing and collect and replace the damaged bit, they caught me off guard by offering the manufacturer.

@mummymayhem18 it was a travel system from Kiddies Kingdom. Checked them out and mostly positive reviews (as positive as a retailer is ever going to be). They sent me a trustpilot link the other day so will be having a few things to say on that I think!

YANBU. Your contract is with the seller - any relationship they have with the manufacture is just that - theirs.

Don't let them fob you off op, tell them you want it collecting and replaced.

If you paid by credit card also raise a complaint with your card company. They're jointly and severally liable for any breach of contract.

I didn't have time to ring and sit on hold today so have sent them another email and a Facebook message stating I will go to trading standards and my credit card company if they don't contact me to make arrangements tomorrow. I wonder if the credit card will refund the whole purchase or just the value of the damaged item 🤔 I'd be quids in if they did! I will keep you all posted anyway, they may yet redeem themselves ..

Amazingly the exchange is happening on Friday. I'll believe it when I see it...but it turns out somebody does monitor their customer service email account. Anyone stumbling across this thread searching by company name please bear this in mind and don't be fobbed off like I was if you do have any problems!

I did 🙂 asked for an afternoon slot if it was for today (due to work) and they gave a morning but luckily I managed to sort it with colleagues. I was VERY relieved when I opened the box to check it that all was in the right amount of pieces!
