Child maintenance?

Posting for traffic, did post on lone parents but no reply

So ex doesnt pay any maintenance at all, hasnt done in a long time, over the years he has managed to get out of it completely. He apparently isnt working or claiming benefits. Cms said today that they will start proceedings to access his bank accounts and take money directly out of his bank account. Has anyone else had this happen? I know so many struggle with CM so struggling to believe it will happen. Anyone had this.

I’m not in the UK so it’s a different system. However, I have been single since my child was born, and have never received maintenance. I know it’s hard and unfair. I also think any father who is absent is an idiot and totally missing out!

If CMS is going to do that, that is great! I hope they can get it for you and your DC Flowers

Hi, Yes I had this but because he was running a cash in hand business he didn't keep his money in the bank. CMS are still being useless despite me phoning them every week. All they go on about is HRMC records, despite him not paying tax. Claim have all these powers but they don't use them and everything takes months/years to actually do anything. I've had non stop problems with them. Keep records of every time you call, who with and what is said as you will get told different information. Also report to tax evasion as must clearly be working cash in hand.

You could ask for an additional income variation, they'll ask him for info, the variation will be unsuccessful (it usually is), but then you can start the ball rolling to appeal.
The appeal eventually gets to a tribunal hearing where the judge has more powers, and can order a financial investigation, but the Judge will also take into account any evidence you can give.
Does he have a flash car etc etc?

I went down this route and won. Quick typos as off to work

No he is completely absent through choice (hasnt seen them in over a year.)

My daughter's dad didnt give me any money for her and i applied for child maintenance in early October. They told me he is on benefits so i get like £7 a week..yeah its ridiculous but better than 0. They took forever to set everything up and set his first payment day to like 3rd December. He didnt pay anything and was told to wait a week to give him time, still nothing so i contacted them again and later that day he sent £60. As i had contacted them and he was 2 weeks late paying they changed it to collect and pay so from now on payment automatically comes from his account on the 1st of the month.

Thanks but he is not even on benefits 😐 its a joke really! It really is possible to avoid paying maintenance. He probably thinks he is so smart Angry

I have 3 freinds who have received a penny for years despite CMS being involved . I'm about to start the process of trying to get money out of my husband, he moved out in June and I've had zero. He is a builder and unlikely to put his earnings through the books so unless he agrees to pay I am unlikely to have any joy via CMS.

Yes I receive my maintenance this way. It's a deduction of earnings order. They send his employer a payment schedule and the employer deducts the amount from his wages before he is paid and sends the funds to the CMS and they then pass them on to you. The charge you both a fee for this.
