Ending private tenancy

Hi there,

Sorry to post here, i know wrong place, but posting for traffic

Currently on a periodic monthly rolling tenancy and am due to sign for new place soon and this is likely to be next week - so will be giving the LL 30 days notice

My question is, can you end a private tenancy MID month, say for example I send LL a letter giving 30 days notice on the 5th of December - will it end 5th January?

I know this may seem a silly question to some, but never been in this situation

I have spoken to the LL about this a few months ago, when the lease lapsed and we went periodic instead and he just said 30 days notice, no mention of calender month dates, so maybe im over worrying

No, it will be written in your contract that you have to give notice on the correct date, usually your rent date as that would be the date the "tenancy" starts for 30 days

You can ask the landlord if you can do what you plan but they don't have to agree

Usually it has to be in line with a rental period if that makes sense?

And when I say contract I mean the original tenancy agreement, when moving to periodic all the same terms apply

There is nothing in writing in my contract to state a date

It is a shame I cant sign for the new place this week and get it done this week before month end - however I just darent hand in notice until i have the new keys

Yes I see what you mean - I have just re read the original agreement and nothing in there reference this stuff at all - I will give him a ring tommorow and see what he says

There's usually a whole section about end of tenancy, which will cover notice, allowing viewings etc

There is a very short clause about the tenant giving notice

'any such notice shall be deemed served on the LL at the following address using normal means of postage....'

Ours was written into our contract, even stating when/if it went on to a rolling contract the notice period was in line with the rent period. If it's not there in the 'ending the tenancy' section then you can give your notice when you want.
