So I ordered a purse online from a well known brand.
I paid £12 so cheap and cheerful.
The parcel arrived today and it was well packaged in a nice box and wrapped etc.
I opened it and it was a different purse (loved it ) and I checked online and it is selling on the site for £100 Shock
Moral dilemma ...keep or return ?
Would you tell them ?

I'd personally keep it. If they are a huge online retailer it won't affect them like it would a small business. They probably make that money in minutes.
As to someone getting fired over that, they probably already would have been so it wouldn't make any difference whether you return it or not.
Theft? Really? Well they sent it to you instead of what you ordered so I don't think it constitutes theft.
I doubt you'll hear back from them, especially this time of year so I'd not worry.

Tell them but bill them for your time to return/send it back. It is their fault not yours and it is inconvenient for you, what if you didn’t like the one they sent? What if one you wanted had also been 100. Say everything reasonably and they’ll tell you to keep it anyway. I wouldn’t lie or keep quiet, if also want the one I ordered. X

I thought you had to tell them you had it and that they have got six months to collect it and if they don't, you can legally keep it.

I’d tell them but make sure they know it’s their error you never know they might let you keep it as compensation - it may be cheaper than them paying to rectify it as you shouldn’t have to pay the postage to send it back or to get the correct one not to mention your time they have wasted by this error!!

Thats what's wrong with the world today. We're oh so quick to complain when someone sends the wrong thing that's cheaper, but we keep stum when they send something better. It wither works both ways or neither. So what if they're a big company. If they find out, and you haven't told them, either you'll get branded a thief or some poorly paid clerk will have to pay for it/lose their job.

Call them. Tell them what they sent and chances are, they'll tell you to keep it. If they insist you send it back, then tell them you'll do that if they send packaging with postage and send your correct purse first. But I'm betting they'll tell you to keep it.

I once got a £100 dress free when it wasn't scanned at the till. Probably the only good thing to ever happen to me.

I ordered a CD from Amazon which has arrived. I've also had an email apologising for the delay but delivery would be later than planned and they'd let me know when to expect it.

Not saying it’s morally right to keep it but....citizens advice clearly says that if you have already bought an item and it transpires the price was incorrectly lower than it should have been you don’t have to give it back and they can only make you pay the difference if you’d talked about the correct price and they still mistakenly charged less.

If you buy online it’s legally yours once you have a contract in place I.e either once you’ve paid for it or once they’ve despatched it to you. Even if they realise at that point they can’t cancel your order as that would be breach of contract.

It surely can’t be theft. It was sent to you and you paid in good faith. You didn’t find it and not hand it in, you didn’t sneak it into your bag or even find it in your bag. You didn’t steal it. Theft implies intent.

Jeez how much more mileage is there in this thread? OP asked a question calling for a legal answer so some lawyers provided it and plenty of people don't seem to like it. Maybe if OP's question had been about an electrical problem there may have been some comments by electricians. Then a bunch of people who once wired a plug could slag off the professionals as not knowing what they are on about.
If as well as sending the wrong purse the company had billed the correct amount for it I'm willing to bet it would be theft then but by the seller.

Given that the people concerned gave advice based on what the law actually is (and that can very easily be verified), yes, I believe that they probably were lawyers.

HonestLawyer we are giving her advice from a morality point of view. You get to give the legal perspective.

Not saying they aren’t aligned. But the law sometimes is to stop costly conflicts over trivial matters. But morality, covers even trivial issues.

Legally you are fine to keep it if it had been in a shop and labelled like it is you are entitled to it at that price otherwise it is false advertising if not so as it is also labeled wrong you’re protected by consumer law :)

Bubblegum. I’m not sure that’s correct? Until a ‘contract’ exists I.e you’ve already paid the shop doesn’t have to sell you the item if it’s been accidentally mis priced.

HonestLawyer. You might want to have a word with citizens advice as they appear to be giving out the wrong advice on their website if what you’re saying is actually true!

Thunder. I don’t think they are. The information is clearly stated under their ‘if something is advertised at the wrong price’ and gives different scenarios of buying in store and online.

It also very clearly states “if you have a contract, the company can’t usually cancel your order even if they realise they have sold you something at the wrong price”.
