Child DLA advice

I’m hoping someone can help me. We are 47 weeks into an appeal, which is pushed back every two weeks, on an annual child DLA payment or lack thereof, but as the application was rejected in October we are now effectively into the next period. Should we be applying again? And I take it if we do it won’t cancel the current application?

Thank you. I joked to my spouse we’d probably be permanently in appeal one way or the other.

Hi - no, the appeal stands as it is. The courts are just horrendously backlogged right now.

If you can prove that the delays are causing unnecessary hardship, take your case to your local MP - had success with getting earlier dates when MPs have intervened.

Also ask to go on the cancellation list and if possible that you're willing to go to another local court.

P.s. do NOT withdraw your appeal as you'll lose your claim on backpayments which can be considerable.

Thank you for the above and sorry to sound dense but do we put in for next years claim now or does it have to happen after the appeal?

Have they sent you a letter asking for a claim review? If they have then yes you will need to do this. As far as I'm aware you shouldn't need to claim every year as a matter of course?

We’re under juducial apoeal so never received a payment last year. Effectively the cycle could start again but we’re unsure if it does.
