Child dla appeal query

Hi,

Our child has had an appeal outstanding for 42-43 weeks. Every time we ring the local court for an update we get a different explanation. They even contradicted citizens advice.

The latest they said is if it gets to 44 weeks they send the case back to DWP Birmingham.

Does anyone know what happens then?

We’re thinking the appeal may never get heard.

Any information welcome.

I have no advice sorry but there are some great dla fb groups if your on there, they have lots of advice.

Head over to the special needs thread there's usually a few dla chats going on over there. I've never read one that's gone on as long as this though!!

Ours was over a year waiting for a tribunal date

My original claim was a good few years ago but we waited for 22 months for tribunal

Appeal will get heard, it can just take a long time. As you’re nearly there I’d make sure you are ready for a hearing. Is there any new evidence (relevant to when the decision was made)? Are there any dates coming up when you can’t attend?

I’ve never heard of cases being sent back to DWP without a decision. That doesn’t sound right at all.

Thanks all. I’m struggling as well to work out how to describe the condition as well. As being a child it develops in a year. So trying to work out how to reffed to it at that point in time. We’re just annoyed as every time we phone we’re told it’s in two to three weeks and every two to three weeks it moves.
