NDN said I can’t get a dog

This is my first post but have been lurking for a while.

My DP and I own a flat which is a first floor maisonette in London. We have been talking about getting a puppy for a while but haven’t yet taken the plunge. We are currently looking after a friend’s dog while she is on holiday and thought we would treat it as a bit of a trial run (although we know a puppy would be much more work). So far it has gone really well.

So downstairs have moved in fairly recently and are renting. I bumped into the guy as I was returning from a walk with friend’s ddog. He told me that he girlfriend was allergic and didn’t know we had a dog when they moved in. I said we were only looking after him for 2 weeks but we’re thinking of getting a puppy in the near future. He told me I couldn’t and he would sue me if I did. I was very taken aback and basically said nothing and went into my flat.

AIBU in thinking that we can get a dog if we want? There is a small communal corridor then our flats and gardens are obviously complete separate. I’m the only one who cleans the communal corridor anyway and I don’t mind doing this even daily if that helps. I don’t want to make anyone ill but we’ve had the dog here for over a week and she’s been fine. Just don’t know what to do as I really want a dog

Provided there's nothing in your deeds about pet ownership then he can do one.

Providing there are no restrictions on the building as it has communal areas, tell him to f**k off.

Look at your lease (I assume it's a lease hold flat - it will be there, not the deeds).

If there's nothing in there, you can ignore him!

Seriously if there’s nothing in your deeds then ignore. As you say you’ve had the dog for a week and they didn’t even know.

Lots of lease agreements do prohibit pets so I would check beforehand.

Yes check your paperwork. His attitude stinks so don't feel like you owe him anything. As you said the dog has been there a week and his girlfriend hasnt evwn noticed. I would suggest more give and take if he had veen polite and reasonable but threatening to sue you makes him rude.

We are share of freehold but there’s nothing in the lease regarding pets. Would have be a deal breaker for me to buy the flat tbh!

I don’t want to upset them and I obviously don’t want to make her ill or anything but I don’t think it will as I assume she’s been fine for a last week

Sue you for what? As others say, so long as there’s nothing about dogs in the deeds (covenants set by the freeholder etc), they don’t have a leg to stand on.

They may have concerns about potential noise/smells/mess which are perfectly reasonable but how much legal clout that has is questionable.

He can't be that allergic if you have had the dog for over a week and he has been symptom free and not even been aware the dog was in the building

He sounds like a busy body, if you want a dog, get one...neighbours can't tell you what to do in your own home as long as you arent affecting them and you keeping a dog there hasn't affected him

We have a mixture of carpet and laminate wood but we have tonnes of underlay and sound proof as previous tenant watched loud tv and it drove me insane haha

Just get one if you want one. He has nothing to sue you over. It's all talk. Although it would give the judge a laugh if he bothered.

Check carefully that it doesn't say anywhere on your paperwork that dogs aren't allowed. Then if that is okay, get a dog if you want one. I've been in a similar situation with a busybody neighbour. She whined and bitched about my dog, but she couldn't actually do anything. What's this guy actually going to sue you for?

So do you think I should tell him we are getting a dog when the time comes or just get one and ignore him? I don’t bump into them very often

We've just got a cockerpoo because they are generally low allergy (and she looked like a tiny furry gremlin). DH and I are both have allergies and we are absolutely fine with her.

Wish we had done it years ago to be honest, forgot how much I love being ruled by a tiny bitey dictator!!!

Stop discussing anything with your neighbours. Pleasantries only. If they confront you say "oh dear, it's a shame you feel that way" and don't engage.
