fitness club misleading people

Will a fitness club pass your details to a dept collector if you refuse to pay 100 pouds?

I have been a Gym member with a few months and as it happens in many gyms they are now making it difficult to end my membership. I have been mislead multiple times by receptionist that I could end my contract any time and now when I would like to end it they want me to pay 100 pound to end it, which was never mentioned before!!. If i remove my direct debit will they pass my details to a dept collector? I got a good credit score that I dont wanna ruin, yet it is very annoying getting mislead to a fitness club this way.

They can as you have signed a contract with that charge detailed.

Wether they would or not is very different.

Technically they are right. You can cancel at anytime. That's different to asking if there are any cancellation fees.

Do you have a copy of the membership contract? You both have to abide by it. Is it part of a chain?

I wouldn’t particularly worry about this. Debt collectors can only action undisputed debts, and you’re disputing it. However I know gyms can be total nightmares and it does seem like it’s going to be a lot of hassle.

I’d start by launching a formal complaint telling them why you’re not paying

I don't think that saying you can end your contract any time necessarily means you can do so for free, as annoying as it is.

No idea about when a dent collector steps in I'm afraid.

@thatsfuckingshit I believe that this things should be mentioned to one aswell as things like notice period which was also never mentioned when I asked about cancelling and all over sudden I cant cancell anytime anymore i need a month notice.

@austenozzy Yes, I do have a contract which i have only beengiven a few days ago when I have been a member for almost a year...this was a way of them tricking people into something... its a part of a chain, its virgn active Gym to be exact and I have read some horrible reviews about them and advise anyone to NOT join them!

@glintatible yes i have disputed it, the problem is the customer service team wont even let me speak to an actual manager they are trying to make the decisions and its terrible dealing with them same with the receptionist...its like the whole company doesnt have any managers i dont understand why such a big company would be so money hungry and ruin their reputation and lose a clients??? Thats a huge issue with most gyms, once you sign up they never want you to leaveagain, they basically want you to sign up for life !

I tend to feel that if companies won’t communicate with you fuck em. Why should they get your money when they can’t be arsed to offer customer service?

I would email a complaint and dispute then forget about it. If you get a letter from a debt collector you can reconsider then

So you didn't sign a contract when you joined up? I find that highly unusual for a large chain.

Why didn't you ask for a contract when you joined? Gyms are pretty notorious for making it difficult for you to leave

@kaytee87 when you join they give you an electric agreement for direct debit but that was an actual contract aswelll but they dont tell you that youre actually signing a CONTRACT and not just setting up a direct debit and they wont provide you the contract you signed for untill you ask for it!

Well if they didn't inform you of the terms and conditions before you joined then you can't be held to them. Ask them to show you your signature on the terms and conditions that state leaving notice etc

another issue is if i dont pay and they take it to a dept collector I might not even know about it since ill be going away for a few months
