To be absolutely fuming and wonder how people can do this

Long story short my sons been ill recently in and out of hospital. I needed a new pram that could fold up small and was light weight so as I could easily bring it to the hospital in the ambulance as my stokke xplory is way too big and doesn't do the job. I decided on a bee and bought it second hand on facebook marketplace. I went to pick it up an made sure the woman showed me how it all worked and that it was in good condition etc. Got home and after not even a day the problems started. The folding mechanism gets jammed all the time and you never know if it will fold or not. It's currently at a friends house as I couldn't get it to fold and go in the car so have been left without a pram. Not only this but the frame unlocks at one side making the pram go lopsided and feel unsafe. These are obviously not new problems and started on day one of me using the pram. I'd even told the woman why I wanted the pram and she said she'd gone through something similar! I know this may not seem like a big deal but it was really important for me to get the pram so as I could go on walks with DS whilst we're in hospital so I'm absolutely fuming and I can't even sell this pram on to fund a new one. AIBU to be this annoyed and does anyone have advice of what I can do? x

Nothing I’m afraid, it was sold as seen.

Very annoying for you though. Some people just have no morals when it comes to these things.

ClopChops · 23/04/2018 17:24

Did she specifically tell you it was in “good condition”? Was there anything on the advert to the effect of “sold as seen”?

Sorry about your DS, hope he gets well soon Flowers

Caveat emptor. Throughout history people have tried to screw others over in this way. YANBU to be furious but there is nothing you can do. Can you look into getting it fixed?

Aprilmightbemynewname · 23/04/2018 17:26

I would call her out on it via fb.

frootlooop · 23/04/2018 17:28

@clopchops yep she said it was 'in good condition and perfect working order, few scratches as can be seen' And thank you he's doing amazingly well he's very strong! I know there's nothing I can actually do just needed a rant and to see if the problems might be fixable. just don't know how people can do that x

Maybe you could just message and tell her your situation. Not in a nasty way, but I would want to know if it was me. Maybe an apology would make you feel less mad?

IamtheDevilsAvocado · 23/04/2018 17:36

If she said it was in good condition... This includes it working properly

I would dm her and ask her to refund your money...

Yes I know it's not a shop etc... BUT at the very least you can expect it to work!

ClopChops · 23/04/2018 17:38

Well actually I would go back to her - if she has represented to you that it is in good condition, which it isn’t, then that is a misrepresentation and you can potentially get out of the contract (assuming you relied on this before agreeing to buy it).

I am not sure it is economical or worth the stress of going to court over it but it’s not as simple as caveat emptor where she has made false representations about the condition of the product, so it could be worth a complaint to her.

Pleased your DS is doing better Smile

Email the pram manafacturers to see if this is a known fault and if they can assist.

It'll take 2 mins to write an email and hopefully they'll be able to set you right.

Go onto the Citizens Advice website and get the number of the consumer helpline. Some of the information on this thread is not legally correct.

I had the same problems with my bee. The handle wouldn't stay locked so we contacted the company and they sent a replacement mechanism/ handle lock. Was easy to fit.
Another year or two later, just as ds didn't need a buggy anymore, the bee stopped folding. So irritating as we wanted to sell it on with all the accessories. In the end, we just gave it to a friend for the school run. So I think this must be not a one off problem with just your pram, unfortunately. I'm sure the lady must have known it had problems but don't think you'll get a refund, sadly.
