Aarrgh -Nothing in 3yrs has delurked me until sheer frustration at our buyers!

2 days before exchange and they've pulled out, having delayed an extra month from original completion date.

Not only do I love my house, having spent 2yrs renovating it (link to pics below) so fierce house pride but their timing is awful given I'm already commuting 3.5hrs each way for my job relocation and we'll now likely lose our house we were ready to exchange on..but we're also now screwed in terms of location search as already submitted son's primary school applications!

Reason being; they felt pressured to buy. Odd that a seller would want their no chain buyer to exchange 6m after offer!!

I dont think a deposit should be handed over presurvey unless the buyers can get it back in there are hidden isdues. My cousin went to buy a house and there was terrible damp and structual issues painted over! Hidden or attempted to by the seller. People shouldnt lose a deposit in those situations but minus some major life changing even then yes sellers should be compensated by time wasters and gazunderers fined.

We had an offer from a local builder.
It was considerably less than we had hoped but we were desperate to move (health issues).
He then droppped the price by a futher 28% on Christmas Eve at lunchtime with a 4pm deadline to accept. We said No.
We got stuck in the house.

OP what is happening re Schooling in Bellingham???
(reason we didnt relocate there last year)

So thought that thread title was going somewhere different..... even imagined scenarios for quite how that situation had occurred slow day at work.

That said, I am really sorry to hear about your buyer pulling out. Been there and had that happen & it really, really sucks. Until the absurd system we have here in the UK changes, I don't think there is much you can do, but fingers crossed you find another genuine buyer soon. It is a good time of year to be on the market.

I hate the whole house buying/selling malarkey.

Our last-but-one move, we exchanged, everything seemed fine, completion/moving day was set, the day arrived. Our removal van came and loaded up and set off towards the new house. Then we got a phone call from our solicitor to say that our buyer had failed to complete on the agreed day, since he and his solicitor had failed to sort out the money to be ready to pay - despite having done proof-of-funds and deposit, etc. This was on a Friday. The person whose house we were buying then had to be told. We ended up staying with friends and the removal company arranged emergency storage of our stuff. Our solicitor worked like a hero for 5 days. 5 days later, useless buyer(a property developer) finally completed. He had to pay compensation, plus the cost of storing our stuff, plus the cost of the extra days work we had missed. Luckily our removal company were able to complete the removal on the rearranged day. It was all horrendously stressful.

13 years later we felt brave enough to move again! We found a buyer after two months, found a house to buy, all going well. Our buyer pulled out about three weeks before we were due to exchange. The whole chain teetered and our sellers got cold feet and talked about not selling after all. Our estate agent threw potential buyers in our direction and managed to find us a replacement buyer FOUR DAYS LATER! This meant the chain was saved. It did delay the process by several weeks but we were able to re-use some of the existing paperwork. The original buyer apparently rang our estate agent with a lower offer the following week and was most put out when they were told we had already agreed to sell to someone else. 😀. Luckily this time completion day went smoothly.

Not planning to move again for a long, long time... Hope you find a new buyer soon OP.

Happy, yes, we said no. They were shocked apparently.

No they are very frustrated because it isn't selling, according to the estate agent.

The sad thing is we couldn't afford it now as prices have gone down where we live. Our house is now worth 7% less than when it was 'sold'. Prices where we are buying have stayed the same.

We had this happen to us many years ago. It was our buyers who pulled out at very short notice. I had to phone the woman we were buying from to let her know our sale had fallen through - she was in tears, I was in tears. Their excuses for pulling out were ridiculous and I wrote them a letter (nothing aggressive or threatening) but making them aware of the chaos they had caused, and suggesting if they wanted a hobby (we discovered they had done this to another seller) they should find something less expensive/disruptive and stressful to others to fill their time. They threatened me with lawyers when they received it (truth hurts) and I said - go ahead, it's all statement of fact. Sorry to hear you're going through similar.

If the Tories or any other political party really understood the average person's lives then the house buying law would have been changed years ago. Scottish law unless something better can be found would be a start.

YABU. Probably the biggest purchase of their lives and they have to do what is best for them and their family. It's unfortunate but you cannot expect them to exchange on something they don't feel 100% about just to not be seen as being unkind.

It’s actually a voomon myth that offers are legally binding in Scotland. You can pull out but it has to be done before the missives are concluded. My friend had a cash buyer all good, bloody pulled out a week later. It’s more unusual for offers to be rescinded and you can’t gazump, as once the missives are done both parties are considered to be locked in.
