Who is BU?

I won't tell you which person I am as I honestly want to know if IBU...
Person A has a car she has a disabled husband (he is mobile and does not need to be driven around 24/7) a 1yr old child and is 6 months pregnant.
Person B is a shift worker (mostly nights) her and her husband has had a tough time lately due to financial problems, and really needs the car for work.

Person A lends person B her car I October. Person B promises to return the car in December (no date specified, but before Christmas) all is fine.

December comes around and Person A asks for the car to be returned within 2 weeks, give or take a few days.
Person B said that she would like the car until January, but this is not a possibility for Person A.
A day before Person B is to return the car, she gets into an accident. Thankfully she is not hurt, however the car is damaged. Her insurers give her a courtesy car. All great.
Person A is angry because she now has no car for Christmas. She said to Person B that she expected a car on day 'X' and regardless she should have one (meaning she should be entitled to the courtesy car)
Person B believes that this accident was no one's fault and all has been put out.

Who is BU??
Tried to keep objective x

Not rtwt but just thinking... do you know the car has definitely been in an accident and she’s not just hanging onto your car for a bit longer? Have you actually seen the courtesy car?

cakeymccakington · 21/12/2017 14:06

Has she definitely got a courtesy car?

Could she just be pretending the accident happened in order not to return the car?

OhBeggerItsMorning · 21/12/2017 14:07

Ah Sparkly, great minds think alike, or are you as cynical as me and don't trust anyone? Great x-post.

diddl · 21/12/2017 14:08

Does her husband know & would he tell you if he did?

If not, might have to be police involvement.

Can't see why she wouldn't just tell you.

OhBeggerItsMorning · 21/12/2017 14:08

And cakey!

Eltonjohnssyrup · 21/12/2017 14:11

I suggest you tell her to give you the courtesy car and process the insurance claim and return it to you or you will report her for driving without insurance.

Masonmumny12 · 21/12/2017 14:14

So sorry I hate drip feeding.... Yes there was an accident. She sent me pictures and my mum has seen the courtesy car. Other than that, that is all I know.

Masonmumny12 · 21/12/2017 14:17

She sent me a reply:

I'll call you later

That was it! Hopefully I can get some more info, if not I will have to mention to her that I am willing to call the police..... Lesson well and truly learned.

You can insure a car you don't own. I do car is registered to dh I am making driver so insurance is in my name. If you insure it in your name and have someone else as a named driver but they drive the car all the time then you can get in trouble for that.

To stop parents insuring kids car in parents name.

When I had an accident I was told by the company that only I was allowed to drive the curtesy car. I think when driving the curtesy car you using the car company's insurance not your own.

B is being u reasonable though to not sort transport for you

CurryWorst · 21/12/2017 14:24

The police won't be interested. You loaned her the car, she didn't steal it. She does have insurance.
The finer points of her cover are between her and the insurance company, its not a police matter so please don't threaten anything.

SparklyLights · 21/12/2017 15:04

We are a cynical lot, cakey and ohbeggar!!Grin

CuriousaboutSamphire · 21/12/2017 15:33

Mason Hold in the forefront of your mind... you said you haven't escalated anything as she is family! She has not accorded you the same family feeling... she has shafted you and continues to do so!

You now only have a couple of options, all of which will leave you without a car for a while:
a) Keep your fingers crossed, say nothing and see what happens
b) Threaten her with legal action. You do not know she didn't register you as the legal owner, so no penalty can apply to you! www.money.co.uk/car-insurance/how-to-insure-yourself-to-drive-someone-elses-car.htm

Me? I'd go for it! Try 101, see what they advise, then her insurer, if you can work that out!

Maelstrop · 21/12/2017 15:43

I think you need to threaten the police. Your cousin sounds very dodgy, refusing to say where your car is. Really weird!

Bringmewineandcake · 21/12/2017 16:02

I would insist on her insurance details and give them a call. She needs to authorise them to speak to you as it’s her insurance policy, but you absolutely have a right to know where your car is, who is repairing it and when you’ll get it back.

CurryWorst · 21/12/2017 16:22

I think you need to threaten the police

For what crime?

cakeymccakington · 21/12/2017 16:24

Refusing to give her car back. It's basically stealing if you refuse to give something back knowing it was a temporary loan

notapizzaeater · 21/12/2017 16:26

She's a cheeky cow ! YADNBU

CurryWorst · 21/12/2017 16:27

Not one the police care about! "Hi, I loaned someone my car ages ago but today I want it back and they aren't answering my text".
Yeah, they'll get right on that. Also maybe tell them your sister borrowed your hairbrush a while back as well.....Hmm

Refusing to give her car back. She isn't refusing though. The loan car belongs to B, she has told OP that her car is being fixed... so she hasn't stolen it.

There may be something 101 can suggest, but I doubt there is anything that can be done via the police. It is a civil matter!

CurryWorst · 21/12/2017 16:33

And if OP calls either the police or the insurance company, the most likely thing to happen is that the car will not get fixed at all.

LurkingHusband · 21/12/2017 16:36

Is it a Motability vehicle ?

Masonmumny12 · 21/12/2017 18:05

@lurkinghusband no it's not x
