Neighbours selling our land.....

So we purchased a house 18 months ago...... it came with 2.5 parking spaces, both on our (one space is half in our boundary and half in next foors) the deeds are very vague about this space. Both our deeds

Yes I’m going to speak to them, they want out and doubt they want a dispute to hold things up.
I was going to make sure that if I was home for any viewings I popped out to the car to get something from the boot to make it very clear. Still only effective if I am home mind. What a mindfield.

Definitely sort this now. Say to neighbours you can see that the Estate Agents have made a mistake in saying that ndn have 3 spaces and say that you obviously need that error rectified and would like the ea to contact you tomorrow to confirm they will alter all their marketing material asap.

If they don't do this they will have to state that their is a dispute with their neighbours and this could cause prospective buyers to withdraw from any proposed purchase!

The spaces are fairly generous, no trouble opening doors etc, there is also a pathway each at each side of the house, we would incorporate ours into the drive and that with the half space would equal a whole space. We would get 6 spaces by removing the front garden too. It would be bumper to bumper but is the same width and length of 6 guideline sized spaces at a supermarket car park (researched intensively) Most of the time it’s just the 2 of us but there is no other communal parking for visitors if we lose use of the space. Every space is owned and otherwise you have to mount the pavement as the roads are narrow (which doesn’t happen often and pavements should be for you pedestrian’s not cars)

Surely I should speak to the neighbours not the estate agent. Otherwise they will have a log of the dispute and I lose all bargaining power Smile

It isn't a dispute with the estate agents though, it's clarification of a point that they have either misunderstood or misrepresented.

It does look from your diagram that the simplest way forward would be to just split the space in half and put a fence along the boundary.

Your neighbours are in the wrong about the 5th space. But YABVU concreting over your front garden to make a car park. It will look terrible and increase the risk of flooding because you're removing the natural drainage.

That's an excellent idea, actually. Granted the neighbours should have noticed this when sent the draft details, but these wouldn't be the first EAs to stretch a point to get more interest

Do you have decent drainage? All this tarmac is so bad for our gardens. If it’s only occasionally you need extra spaces, is it really worth it? Won’t your view be like looking onto an empty car park?

The only thing that matters is what the deeds say, the neighbours estate agents can describe the space however they like but they can only sell their own land. I would check again with your own solicitor before you make any changes (because otherwise you will be drawn into a dispute which you may lose), and suggest that rather than tarmacking over your garden you consider using gravel or putting netting under the grass to reinforce it. That way you can use that space for additional parking when you need it but not lose the drainage or future garden potential (plus it would be much cheaper).

The deeds state nothing about qty of spaces though Nooka, Literally just says space(s) I think unless we define what land is ours there is always going to be a wavy line.

My solicitor has already looked at the documents again. He just said there is nothing defining it, it’s half your land, half their land and therefore it’s shared.

I have a friend going to call and request to view and mention the fact that space 3 looks shared and just see what the EA says. Go from there 😄

What description was given regarding parking when you were first looking to view tge property? You could show them to NN, was it same estate agent?

You can buy and install rubber matting that the grass can grow through (so it looks nice) but it provides a stable Base that won't get churned up by car tyres. It's used on golf courses to protect areas of high traffic. After a while it reverts to looking like normal grass but is less prone to damage.
No drainage problems and likely cheaper (and much easier) than laying concrete

The house was sold to us with 2.5 spaces, this was stated several times throughout the sale and in several of the documents. The EA said the same when we viewed it and was on the sales particulars.
Another thing is when they first told us the space was theirs they said the sellers of our house never used it (From back when we first moved in) But i messaged the husband today (we’ve been in communication regarding post previously) and he said they used it exclusively as they had 3 cars...... never a problem (same neighbours - although new girlfriend who doesn’t own house but is the communicator of the 2)

Surely if it is absolutely a shared space the buyers won't own it just because the estate agent put it in the description. Their deeds will have it as shared, same as yours and their solicitor will point it out when going through their deeds at exchange. It's irritating but they can't sell something they don't own.
