AIBU to think these fake sickess claimers deserve their sentence?

A couple who sued a major tour operator for damages after contracting "food poisoning" on holiday have been found to be liars and jailed. We've all seen the ads of those scummy claims management companies promising to get you money if you've been ill abroad, and it obviously seems like an easy gig for some people.

Serves them right. The courts are trying to crack down on these sorts of claims which are pushing up the prices of ALL of our foreign holidays to cover the costs of these liars.

Compensation culture at its worst??

We’ve been on an AI holiday recently. The rep told us that if you didn’t report an illness in resort but went on to claim when you returned home their legal team would fight the claim.

You should be made to provide a drs report to prove it was food poisoning and not too much booze or in this case lies. Foreign hotels are now thinking of banning British guests for exactly this reason x

I am glad this has happened. A lot of hotels are actually stopping British people from accessing all inclusive deals because of greedy grabby idiots like these.

If this stops others from submitting fake claims then it can only be a good thing

Why is this such an issue with British guests? Are we just a nation of cheeky fuckers, liars and cheats?

Holiday companies should absolutely be held to account when people fall seriously ill or are injured through their negligence. But the boom in numbers of people claiming for holiday sickness just shows that they are chancers who see the tour operators as fair game for a bit of casual fraud.

Yep, completely deserve it! As do other fraudulent insurance claimants...it's not a victimless crime, we all end up sodding paying more as a result.

They should be punished, but the sentencing sounds harsh to me, especially when compared to other judgements. More than a year of jail is really heavy!

I wonder how much you would risk for defrauding an individual, elderly or at risk, (not much if Watchdog is anything to go by) and why she's getting only half his sentence?

They’re scumbags who need to be punished as a warning to others but it’s a classic example of a case that makes me think “why can’t we punish people properly without banging them up?”

Prison is hugely expensive, it loses people their jobs, it punishes the criminal’s dependents, and over crowding leads to problems with enforcing drug control in prisons.

These people need punishing but they’re not the sort of danger to society that means they need to be kept off the streets. Why can’t we come up with a form of community punishment that will be seen as properly deterrent and not just a “slap on the wrist”. I see that fatberg in the London sewers needs carting up to the surface by hand...

I work in travel (legal side), I really could tell you some stories.
They've been jailed for fraud, we've been watching this case for months. I was quite shocked actually at the length of the sentence.

I expect that the call centres which used to call you to persuade you to make injury claims after car accidents have moved onto holiday sickness. Those call centres buy data (names and phone numbers) in batches and their staff work from scripts, when one area of fraud is closed off they can just buy different different data for a new type of fraud and fill their boots until the next one comes along. New legislation has made it much harder and much less appealing to make a fraudulent injury claim but holiday sickness claims was wide open to be exploited. There will be a crack down on holiday sickness claims and there will be an explosion of a different type of claim. The government is essentially playing whack-a-mole I think.

I do agree with this and I think there's an element of "make an example" of them as the industry is trying to crack down on fake claims. I'm sure if we put our heads together we could come up with a really good punishment which would cost less and have them contributing to society. Fatbergs are a great idea. I also hope they will be asked to pay back every penny, as well as the tour operator's costs.

Definitely. And if may be that the "no win no fee" system is unavailable in countries like Sweden, Germany or the Netherlands.

I hope every single fraudulent claimant gets jailed, and has to pay back five times the amount of compensation they received. People like them make me sick.
I used to work in an hotel in a popular resort which went bust because of ridiculous and unproven claims which went to court and were awarded large sums. The travel companies used to substract the money from what they owed the hotel, and the hotel rarely received notification of what was going on until large chunks were missing from outstanding payments. The hotels are the first victims of these fraudsters.
Funnily enough, there were very rarely compensation claims from French, German and Italian guests. It's definitely a British thing.

It’s the new ambulance chasing. My mum lost three days of her holiday to a sickness bug. The other people in her party were unaffected so it doesn’t seem to have been the food. She would never dream of claiming against the hotel.

I totally agree that we need to re-think Custodial sentences.

Have a read of today's news and you will find offences from possessing child abuse images, DV, to violent assaults on Toddlers and the perpetrators will escape Prison because of a lack of 'programs' within them.

Cut down on Custodial sentences and run the programs within Prisons.

We've got things very backward when people who commit fraud go to prison and rapists don't.

God I get sick pretty much every time I go away, it has never even crossed my mind to blame the hotel or make a claim.
But then I don't entertain any of these where there's a blame there's a claim cold call companies, whether it's ppi, accident or whatever.
I was in a car accident a couple of years ago, got hit from behind but quite gently and was completely unharmed. The amount of calls and pressure that was put on me to claim was overwhelming, they kept saying, well you might not know yet if you are injured etc etc. I had to rather forcibly tell them to do one in the end.
I think this culture we live in now is abhorrent and it takes away from the real people who actually do suffer from genuine food poisoning/injuries etc because there will come a time when no one is willing to believe them due to all the other people crying wolf.
