To think this is an unfair holiday entitlement?

Started a new job this year (retail if that's relevant, so work bank hols), and think the amount of holiday entitlement I've been given is unfair / possibly illegal..

I work 20 hours per week, usually over 5 days (contract states 20
Hours working 5 from 7 days).
My holiday entitlement is 14 days, but obviously to take a single week off I need to request 5 days leave, meaning in an entire year I would only get 2 & a half weeks off Shock
AIBU to question this?

The holiday year runs 1st May - 30th April, I started in June.

Everywhere I've looked states minimum holiday entitlement is 5.6 weeks & if you work 5 days you're entitled to 28 days holiday so not sure how this company are getting around this?

It seems they've calculated my holiday assuming I would work 2.5 days in a week (which is 14 days leave using the 2.5 x 5.6 holiday calculation ) but I don't do 2.5 days Hmm

Is a full time week 40 hours?

If so you're working 1/2 full time so you get 1/2 full time leave - 28/2 - your 14 days leave are 8 hour days.

It will be calculated on your actual hours worked, not days. So if you work 4 hours a day you'll get x amount of hours holiday I would assume. So to book a week off you'd request 20 hours holiday out of your allowance.

You're not working full days though, you said yourself that you're only working 20 hours per week. The 5.6 weeks example is for people working full time hours over five days, which if you're only working 20 hours, you're not doing.

Sorry just to clarify, yes full time week is 40 hours.
The holiday has to be booked off in days not hours so to book a week off I have to book 5 days leave (I would paid for 4 hours across the 5)

It should work out by hours eg you are not taking a full day off, you are taking half a day off. You need to query how they will work it out though - is a day 7.5 hours?

Also just to add my manager has told me it works out as 2.5 weeks holiday that I get for the year as it's days not hours I can book off.

My annual leave allowance is calculated in hours for this reason: where annual leave is calculated in days, it assumes you work a standard length day which, obviously, you don't.

Working part time in retail your holiday is usually worked out in hours rather than days so I would question it.
That said, when in the year did you start? Every week worked in the year you build up entitlement, so someone who starts in April will have a whole years entitlement, where as someone who didn't start till January will have a quarter and so on.

I think they are wrong too. There was a similar thread the other day. Either work it in hours (112 hours) and book 4 hours for each holiday or in days (28) where you will be paid for 4 hours of each holiday day

That seems really odd. It should be 14 full days as others have said which works out at 28 half days. Do you have a HR department you can talk to?

I work 25 hours a week, 9-2 though its flexible.
I get the same number of 'days' as other employees but my day off is 5 hours and theirs is 8 hours.
If I want a week off its 5 days leave.

They're wrong. You're right. The gov.uk website has the calculator on. Can you contact your HR department?

Contact ACAS for advice. I am pretty sure that this would amount to unfair discrimination against part time workers. If you are working 5 days a week, you should be getting the full time equivalent of holiday (as you will only be paid half the rate of the full time employee). Obviously it's different of they are planning on doubling your holiday pay, but I doubt they are.

The company doesn't have a HR department, I will bring it up with my manager on Monday & get more clarification.
The system we book holidays through is an online app, it only lets you take it through days not hours, so I queried it last week & that's when I was told it would be 2.5 weeks per year my allowance would equate to.

If you're working 5 days everyweek then it doesn't matter that the holiday is not calculated in hours. You are also entitled to 28 days per year (so slightly less this holiday year if you only started in June).

It's not 5 days a week every single week but mostly, occasionally I do 1-2 full days a week so only do 3 days those weeks, not sure if that makes a difference?
