to think the employment tribunal time limit should be lifted for those that couldnt afford it?

People who paid fees are going to be refunded, but that doesnt help the people who couldnt afford the fees and so didnt get justice.

Normally it should be done within three months of the incident or of the end of employment, but AIBU to think that if someone has evidence of misreament/discrimination during the period that fees were payable, they should be allowed to bring the case now? Say within 6 months?

As always it will be the lowest paid workers who wouldnt have been in a position to find the money upfront, and they are the ones who will have suffered most as a result.

YANBU. I wonder how many low waged women are putting up with being sexually harassed because they cant afford to risk losing their job and/or bring a case.

Not just women, men who are bullied out, disabled men and women who are discriminated against, parents who want flexible working.....

It would be impossible to put a number on people who couldnt go to court due to the fees, but I would bet it is well into 6 figures.

Whilst I agree with you, the time that has elapsed may make it unviable for those cases to be brought Tribunal - when bullying often relies on key information gathered from witness statements and internal investigations that probably never took place.

The 3 month time limit is in place because those circumstances are often time and context sensitive, and organisations have a great ability to kick stuff into the long grass when it suits them.

Thank goodness the fees have been ruled unlawful though! That is good news.

And Tribunal is still extremely expensive and stressful even without Tribunal fees.
