To not preemptively report neighbours to the police?

I have a large back garden, large enough to have a trampoline, swing set with climbing ropes, cargo net and shoot. There is also a skateboard ramp type thing. This part of the garden isn't visible from the side gate.

Over the summer dss13 used the garden with his friends so the side gate wasn't always locked (with padlock and key). DH actually lost the padlock at one point so it was unlocked all the time when we were at work and dss13 was at summer clubs.

As the schools went back last week I asked dss19 to pick up a padlock and lock up before going out Friday morning. Dss19 picked one up and returned home, locked the side gate (without going into the garden). He was wearing his headphones (this is relevant).

I got a call from nice neighbour as he heard shouting at my front door with other neighbour banging on it. He was gone by the time I got home but left a note.

Essentially his DW had let their 3dcs (under 7) play in my garden (without our permission). This is something that she had done many times before when we were out. She then tried to leave but the side gate was locked. She had told her DH that she shouted at DSS who locked her in anyway. She got upset called him very upset as it was raining, kids crying etc.

Her DH had to leave work and get ladder to get them out of garden. The side gate is metal and is part of our garden wall. The note said that we were out of order, we have traumatized the DCs. He intends to report us to the police for unlawful detention. Hmm

Both DH and I have tried to speak with him and his DW over the weekend but they never answered their door. Dss said he didn't hear anything as he had his music on. I have suggested to DH we write them a letter. Telling them they were trespassing and shouldn't have been in the garden and that we are not responsible for what happened. DH also wants to preemptively report the neighbours to the police just encase. I think the neighbours are all talk and won't have went to the police themselves. DH disagrees. Should we report them?

This reminds me of that thread a couple of years' ago when the neighbours were using the OP's pool when they went out. She only found out when she came home earlier than she'd told them I think.

If you do write them a letter, don't forget to put:-

"PS. We herewith deny your implied right of access"

Might make them think you've been to a solicitor - it'll mean any time they or one of their DC put a foot on your property ever again, they are definitely in the wrong!

On a more rational note, I'd be sending them a little cease and desist from my local friendly lawyer.

And then telling every neighbour within a 3 mile radius what the tresspassing nuts had been up to.

Your DSS sounds fabulous. Swingball is quite a vicious game once people get going, perhaps he and his friends could play that in CFNs garden?

Insurance wise, Scotland or not there could be an element of implied liability but that said as a pp has stated the fact the CFW being present would mitigate that as she'd class as a 'responsible' (!) supervising adult.

It may be worth a call to your insurance company's legal helpline if you have access to one (or maybe through an employers programme?) to see if they'll help sort a fuck right off cease & desist type letter for nowt - those services are 'usually' free.

Failing that my vote is for a MN style party with lots of food & drinks till the wee small hours in THEIR back garden - would be selfish for them to kick us all out hm?

FFS. Neighbour has not long been round.

His DW attempted to get in our back garden again via the side gate. It was locked. Apparently the dc ( who is supposed to be sick) wanted to play on the swings. Neighbour not happy as a- they had been using them all summer and b- he had promised the DC that they could.

I must admit I laughed at this point.

He then said he doesn't think we have the only access rights to our private back garden and has spoken with 'the Council' about us not allowing his family access to 'the play park'.

There is a play park over the back from our garden. There is no gate through our 6ft brick garden wall which was built 30 years ago before the housing estate and associated play park were built. I did point this out to him. He said that park was too far away and wasn't for people outwit the housing estate to use.

I asked who he spoke with. The Planners apparently. Well he didn't because I work for the planning department of our local council. I pointed this out too. He just went all Blush and said he would be speaking to his solicitor.

Fuck me some people are twats.

My advice is to break into his house and crimp out a nice big turd in the family bathroom. Then walk out. Shouldn't be a problem. Mi casa etc.

Just to get this straight - your house backs onto a more recent estate. On that estate is a play park. He thinks that play park is for the residents of the estate, not for people on your street. He believes that your garden isn't in fact yours but is actually a council run park for your street.
Is that right?
