Who pushed that woman over into the path of a bus.

What a complete and utter wanker - who the hell does that?

Thank goodness she was OK (physically at least- she'll probably be rather nervous about walking along the pavement now Sad

I've been thinking about why it took so long to release the video. I wonder if it is because they didn't want to prejudice a potential jury in the case?

If he claims it was accidental they will have to find people who didn't see the video or who will testify that they weren't influenced by it in order to be on a jury in the case. So they've tried to identify him as much as they could by other means and had to resort to releasing this now because they hadn't found him.

stillvicarinatutu · 10/08/2017 15:47

it will only go to trial if he is charged and pleads not guilty. it will be nothing to do with the footage.
cctv is the best evidence there is and its irrefutable if an ID can be made from it. i cant see this getting to a full trial. if he has a lawyer worth anything he will go guilty and take the wrap.

LineysRun · 10/08/2017 15:51

vicar, hello.

Maybe they took a long time to release the video because it took a long time to find the video... although three months does seem excessive 🤷🏻‍♀️

Mustang27 · 10/08/2017 16:11

Why GBH?

stillvicarinatutu · 10/08/2017 16:17

it will be attempt gbh - due to what could have happened if she had landed in front of that bus.

its just about the legal definitions of thresholds for injury.

LineysRun · 10/08/2017 16:18

He's been bailed.

GeminiRising · 10/08/2017 16:21

No I know, but potential jurors will have seen the video and you need to find 12 who have not been prejudiced by seeing it. Given that it's been over every news channel and discussed widely - and there have been excuses given for why he did it - it's not beyond the realms of possibility that he'll claim it was an accident and take his chances in court.

There have been enough people on here and other sites convinced that she did something to provoke him that the CCTV in itself might not be enough to convict?

Let's hope he owns up and takes what's coming to him.

Mustang27 · 10/08/2017 16:22

Hey better hope people haven't figured out who he is. He is not going to be popular.

I'm going to have to look up the differences and what makes a certain crime one thing or another.

I thought it would be attempted murder but I'm not an expert.

soupforbrains · 10/08/2017 16:29

in the UK a murder charge (even just attempted) has to include premeditation and intention. (Killing someone without either premeditation or without intention are manslaughter)

In this case it would be hard to get a conviction that he set out that day with the intention of killing that woman which would constitute the premeditation. In terms of the intention it's less clear, he obviously intended to cause harm but the police would have a tough job proving that he predicted the twist direction and angle of her fall AND that he knew a vehicle was coming to say he intended to kill her.

Whereas he certainly intended, attempted and did cause her injury hence GBH (I was expecting it to be an ABH charge but I didn't know the extent of her injuries which the police will).

As a note, I am not defending him in any way! he's an asshole and I hope they throw as much of the book at him as they can. Just clarifying the categories. :)

squoosh · 10/08/2017 16:34

Not in Scotland. I seem to remember that someone could be charged with murder if they'd indulged in reckless behaviour that caused someone's death. Obv that's irrelevant to this case though.

Elendon · 10/08/2017 16:35

Her injuries are probably mental health following such a shocking incident.

GBH or manslaughter? I'm not sure, but agree with Vicar, if his lawyer is well paid up he will plead guilty to the charge. Five years at most.

HelenaDove · 10/08/2017 16:36

i KNEW he was older than 30 something.

Perillous what people are objecting to are the accusations that she kicked the man.

The police will have studied the video extensively with better tech than what we have.

And there is the fact that this kind of victim blaming occurs all too frequently ...........its automatic almost like a reflex.

Hello vicar :)

Elendon · 10/08/2017 16:37

Forget the manslaughter. GHB or ABH I meant to say.

Elendon · 10/08/2017 16:39

Yeah, I did ponder over his presumed age over his actual age; the latter seemed to fit the picture of him.

Mustang27 · 10/08/2017 16:43

Thank you soup that definitely helps the idiots amongst us......meaning me lol.

Elendon · 10/08/2017 16:45

GBH involves intent to cause injury too.

HelenaDove · 10/08/2017 16:48

Other reports are saying that hes 50.

Hes been bailed. I hope he doesnt go home to take it out on his wife......if he has one.

Pannnn · 10/08/2017 16:51

Well Sec 20 is wounding/GBH without intent.

It just didn't look like the injuries sustained would be up there. Except if she cracked her head badly. Then Sec 20 probs?

Elendon · 10/08/2017 16:53

Sec 20 is the lesser charge over sec 18. However, it was clear this was a deliberate attack that caused injuries the extent of which we don't know.

Pannnn · 10/08/2017 16:58

Yes I know.
But it would be more difficult to prove he intended for her to suffer those injuries.

annandale · 10/08/2017 17:00

Oh bloody hell - the photo from the bus made me think of my xh, though the video and the verbal description didn't -when he was said to be 41 I was faintly relieved, as xh must be 50 now Shock

It won't be him but it also won't only be me who is thinking of an ex and wouldn't be hugely surprised that they'd done something like this.

annandale · 10/08/2017 17:01

According to Wikipedia doesn't GBH have to involve physical injury?

Maybe she cracked a bone or similar.

Elendon · 10/08/2017 17:17

The photo from the bus made me think of my exh too annadale. He's in his 50s as well (and does sometimes go to London to work).
