Continuation of the discussion.

It looks highly unlikely that there will be a verdict today as GOSH have not yet been able to put their case across. The Gard family had their position heard this morning and currently an expert witness from the US is being questioned via video link.

Witness accepts nucleoside therapy can improve function but only if damage has not occurred. Can't repair damage.

Jenna43 · 13/07/2017 16:36

has anyone asked the CA followed what GOSH would gain from lying and manipulating this case? Do they suggest the doctors and nurses get a kick out of a small child suffering? Has any of them given a substantial answer?

Some CA members were claiming if a child wasn't 'perfect' GOSH weren't interested in themConfused and then lots of people agreeing with them saying "yeah my son/daughter has such and such a disease/disability and living a nice life so why not give Charlie a chance. Can they really not work out that their children's disabilities are nowhere near comparable to Charlies?

Bourdic · 13/07/2017 16:36

Given where it all is now, I think it's right for the doctor to come over. The judge should give a very strict time frame for this. What I really don't understand ( along with many others I'm sure) is why his coming over hasn't happened already -how on earth can he give fully meaningful evidence without seeing him? Popped into CA - are these people real?Confused

cjt110 · 13/07/2017 16:36

Surely then, they look to look at whether there is damage by performing the measurements and maybe other tests?

Easilyflattered · 13/07/2017 16:37

I think the media circus has not helped the parents at all, and that if ever a case needed a media ban, until the judge made a final decision, then it's this case.

TroysMammy · 13/07/2017 16:37

How much of the money raised is being used to line the pockets of lawyers? It should be used, if not for Charlie, but for research and maybe one day a cure for this genetic illness.

GabsAlot · 13/07/2017 16:37

Butler-Cole for GOSH continues cross-examining NY expert: asks why he said earlier that brain damage irreversible.

cjt110 · 13/07/2017 16:38

TroysMammy I think they are working pro bono - ie free. So not lining their pockets at all.

GabsAlot · 13/07/2017 16:38

NY expert says he overstated the position when he previously gave evidence.

GabsAlot · 13/07/2017 16:39

NY expert says he was told subsequently of Charlie’s small head circumference and that he has become less responsive.

jellypi3 · 13/07/2017 16:39

Yeah as far as I was aware it was pro-bono - at least the solicitors are. Not sure about the Barristers.

annandale · 13/07/2017 16:39

Not sure about a media ban unless it covered the Internet too - is that possible? The reports from the court reported in the good old mainstream media been the most measured and helpful information out there, unlike FB or indeed MN...

KatherineMumsnet · 13/07/2017 16:40

Hi everyone,

We meant to post on the previous thread - but it quickly hit the limit. We had to remove several parent-blaming posts, so we'd like to ask folk not to do this. We think we can all agree that this is a truly awful time for all involved and we just wouldn't wish it on anyone. If there's anything we could do with more of, it's support. We'll continue to remove reported posts that break TGs (if we've missed something, do feel free to let us know).

If we have to make too many deletions, we will need to look at removing the thread; which is the last thing we wish to do.

Thanks all Flowers

GabsAlot · 13/07/2017 16:40

charlatan if u ask me i sai it but i dint know

rabbitnothare · 13/07/2017 16:41

Oh please stop picking one or two inappropriate posts out of six thousand and making out that it's in anyway representative of the whole discussion.

One sunglasses comment out of seven threads.

GabsAlot · 13/07/2017 16:41

NY expert says lack of skull growth and reduced responsiveness are bad signs. Asked why negative or neutral information means better chance.

rabbitnothare · 13/07/2017 16:41

Oops cross post with Katherine, sorry.

Carriemac · 13/07/2017 16:41

Arranging an mri or CT scan in such a poorly baby is not something you Immeiately , you need a full team of nurses ODAs and an anesthesiologist to accompany them, the risks of moving a ventilated baby or adult are not insignificant so the scans need to be really needed and are not done routinely on every ITU patient.

CaveMum · 13/07/2017 16:41

muckypup the key is that the family don't accept GOSH's measurements. If an independent person does it then no one can be accused of faking the results.

why cant mn just make deltions but let this stand its too important

FlowerSour · 13/07/2017 16:42

So he could have slightly better cognitive function but still be physically just as incapable? Unable to breathe, hear or see?

That just sounds even crueller. If he has little cognitive function right now, maybe Charlie isn't aware of his situation.

I have met deaf and blind children and they absolutely have a meaningful life. However, if the severe brain damage stops him developing cognitively, alongside his illness, deafness and blindness, what kind of life would be this be for the poor baby?

Would he have cognitive awareness? The deafblind children I know have learnt tactile sign language. This gives them the ability to communicate. They have perception. However, if Charlie's brain damage is that severe, he will not ever get to this stage.

So in effect, he could literally just be a person who is breathing. Unable to feel and think as he has never had the opportunity to develop the ability to do this.

Would that be a life?

It is so terribly sad.

TheHodgeoftheHedge · 13/07/2017 16:43

I've seen on several of these threads comments about how much money the solicitors are making out of this.
For what it's worth:

  1. The firm representing the Gards is doing it pro bono.
  2. The judge himself has commented on this being an example of where the changes to legal aid in this country are horrific - in other words, if ever there was a case that should qualify, it should be this, but it doesn't. Very little does now.

Expert says his new opinion is based on new research. But he doesn’t know reasons for Charlie’s encephalopathy: is it structural or not?
