Was parked up on our drive way ( we live on a very busy main road and the engine was off) with my clingy 12 month old on my lap in the drivers seat ( was waiting for someone to move his car seat from their car into ours) when LO honked the horn, wasn't a long honk at all as I quickly moved him away from the horn. family member then walked over and put the car seat in the back of the car and I went to hand LO over to The family member to put LO in the car seat, as I handed him over LO accidentally hit the horn again ( like before was a very short beep). The neighbour then ran out shouting ' SHUT THE FUCK UP!" I quickly apologised and explained that it was the LO and told him that he is now going in the car seat and it won't happen again. The neighbour seemed so angry and said ' I don't care just shut the Fuck up" again I then repeated what I said about the LO , apologised and said we were going out. The neighbour then said ' well why don't you solve the person causing this problem and let him play in the road' he said it so violently and angrily and I am so upset... my LO is only 12 months and he said such a horrible disgusting thing to him and about him!

It wasn't early in the morning and it wasn't late at night ( was 12 lunchtime) and I know that the neighbour doesn't have any young children.

I am so hurt, I feel awful for LO I am now scared to let him play outside in case we upset the neighbour. SadSad

Just a kitten. I agree it's a veiled threat, however for it to count as a common assault, there are key points missing.

Most importantly it can't be third party. The person must fear personal violence. Secondly it has to be immediate

If he said for example; "I'm going to smash your head in" The offence of common assault is complete. What the OP reports is not even close. It's a S5 POA offence at most

Freddy you're right actually, I completely forgot the personal part for a moment.

well, he massively over reacted. thats true without a doubt. However, you don't know whats going on his life there could be a million reasons why he flew off the handle. If hes normally ok, I would give him the benefit of the doubt of him having a bad day and taking it out on you.

being hurt is an odd reaction though. why are you hurt? if he was someone who means something to you, fair enough. but he's just a neighbour.

Rude man

SlothMama · 22/04/2017 18:06

He's a twat, there's no need for his language

flumpybear · 22/04/2017 18:11

He sounds delightful!!!
Next time just tell him he's a nasty piece of work saying such nasty things to innocent children and do everyone a favour and play with the traffic himself
He's the twat, your child is a delightful baby - enjoy your baby and zone out to crappy neighbour!

No worries kitten Smile I was surprised when I first learnt the legislation!

Regardless the neighbour sounds a bullying twat.
