It has become, sadly, typical to hear of appeals for information on male sex offenders - yet when the perpetrator is female, it always seems much more shocking. "

But the perpetrator was not female! Women CANNOT rape. It's a physical and legal impossibility. Therefore - conclusively - the offender was a male.

To compound matters, they couldn't find this evil fucker for a year because the police were more bothered tying themselves up in knots humouring a RAPIST and his silly games then actually trying to catch a dangerous sex criminal.

AIBU to wonder why the police were sharing this apparent 'vulnerable woman goes missing' story when he was in fact a dangerous MALE rapist? And to think that he wasn't a very good example for a story about how shocking female sex offenders are? Suddenly based, presumably, on his clothes & haircut, the police are happy to say "We understand Hauxwell had been living at the address in Newark for several months, without anyone knowing his true identity." WTF is this shit? How have they determined that his gender identity is now male? Did they ask him whether despite 'presenting as a man' (whatever the fuck that means) he in fact 'identifies as a woman'? Perhaps he was 'dressing as a man' because the stupid police were insisting he was a woman, so this made it easier to evade capture? Who are we to presume that his femaleness is negated by his 'presenting as a man'? If a woman presents as a man for subterfuge does that means she is no longer a woman?

The criminal justice system makes all sorts of distinctions that aren't made in the real world. Most people will call the act of being responsible for the death of another person "murder", when it could be murder or manslaughter or infanticide or death by dangerous driving or death by careless driving or causing or allowing the death of a child...most people if attacked would say they were assaulted, they wouldn't refer to being the victim of a S.18 or a S.20 or a S.47.

Either way, yet another discussion about the impact on women of the TRA agenda ends up being all about male victims...

And when referring to the biological differences between male and female the word is sex, not gender. As I'm sure you well know.

Actually the legal definition does not mention the SEX of the perpetrator..it says "a person A..intentionally penetrates..with his penis". The law uses he with everything.
Assault by penetration carries the same sentence (life) as rape.
Presumably a female with a surgically constructed penis could rape just as a man who lost a penis in an accident and had a reconstruction could also rape.
But let's not muddy the waters - the vast majority of sexual offences are committed by people with penises i.e. men and the dynamic in society is that men are dominant.

The gender of the aggressor doesn't matter. The sex does. There is much much higher chance of sti/d's when it's a penis forced into someone than when a female forces herself onto a penis, and the risk of pregnancy for a female victim.

There used to be a term for men who dressed as women, but had not had any genital surgery. Transvestite = cross-dresser, a literal and unemotive translation.

Not a woman.
Not a person who identifies as a woman (whatever that means).

A man, equipped with penis, wearing a dress/skirt. Who, if he is convicted of rape, will not get anywhere near a women's prison.

What went wrong? We really need to keep on this issue.

What about the victim in all this? Maybe it should be up to her to identify the bloody 'gender' of her rapist? Oh wait, she knows he is male, no matter what sick fetish kicks he gets out of pretending to be a woman.

Apart from a minority of genuine people who have a psychological aversion to their sex and undergo penile amputation 'self-identifying' as women should not be legally recognised.

The more shit like this hits the news and boards the more obvious it becomes that the trans movement is a narcissistic and aggressive male trend. Stop trying to pull the wool over our eyes Biscuit. Male = men = penis owner. Penis owner does not = woman and never will. Enough said. By all means men should feel free to wear make up, high heel boots and short skirts if that makes them happy whilst they will always remain male they may push the boundaries of it means to be a male which is not a bad thing. Just remember that most women do not wear make up, short skirts and high-heels but are female, so none of these signifiers have anything to do with sex or gender.

Gender is bullshit, sex is real. What is also real is the aggression and misogyny and concerted effort of TAs to invade female only spaces.

Think about it, if we go along with this, we will not have single sex schools any longer, chaperones in medical settings can 'identify' as female but be actually male, women's sports will be all but dead and women's shelters obsolete, rapists access women's prisons. All because of some people's sexual fetish or psychological disorder.

I have seen the swedish study here which suggests that MTT commit crimes at the same rates as males (i.e. at a significantly higher rate than women), but find it incredible that there seem to be no statistics at all for any other country in the world?!

A solution would be to split the category of rape into three.
eg rape with a penis, rape with a vagina & rape with an implement. That way way the focus is on the aggressor and the victim rather than on what sex/gender they are or identify with.

Since MTT are male, the most trans-friendly result one could hope for is what this study got - same rate of crimes as males.

I strongly suspect that any study in the English-speaking world, where this has become an epidemic, would find much higher crime rates for MtT than for the general male population.
So many of the prominent MtT are criminals, I cannot imagine they offend with the same rates as average males.

And that is quite likely the reason why no such study has been conducted. If the results could be twisted to make it appear that MtT are just a bit less violent than the average male, I wager the transwacktivists would have such a study ready at hand.
With the self-identification laws in many countries, it is obvious that violent males have more of a motivation to self-identify their way into women's spaces, and therefore, much more crimes will be committed by MtT. Doesn't take a genius to figure out that it is not in the TRAs best interest to conduct a study on the respective crime rates.

I think that could be quite sensible Anon - I'd welcome the ability to distinguish the statistics more clearly so we could break down the female rape convictions into:
"Women" who rape with their penis
Women who are a joint enterprise to rape
Women who committed rape

So women are raped in horrific numbers by men with penises around the world. If they are impregnated they may not be able to access abortion and will be forced to give birth to a baby they did not want. Sometimes they may even die during the pregnancy. Sometimes they may contract HIV and die that way.

Transwomen are raped by penises.

Men are raped by penises.

98% of sexual offenders are men.

But come on ladies, let's not let the above detract us from the real issue at hand here. Which is of course whether, despite the fact their crimes carry the same sentence as rape, women who commit serious sexual assault should be referred to as 'rapists'.

Rape is a statutory offence in England and Wales. According to the law, a rape can only be committed by a male as the penetration can only be done with his penis. If a victim is forcefully penetrated with an object, this is classed as "Sexual Assault by Penetration".

The offence is created by section 1[1] of the Sexual Offences Act 2003:

“ 1-(1) A person (A) commits an offence if—
(a) he intentionally penetrates the vagina, anus or mouth of another person (B) with his penis
(b) B does not consent to the penetration, and

If that's the case, then the Andrea Darling (who wrote this article yesterday on "The truth about female sex offenders" Hmm ) must have been mistaken when she reassured everyone on twitter that her statistics for female crime did not include "women" with penises. Or am I missing something?

I know a boy who was held down in an empty classroom by a gang of other boys while a girl sexually abused him. The girl was very mixed up and also had full sex with her younger brother.

But these incidences are a tiny, tiny minority. It is overwhelmingly men who are rapists.

The police probably find it difficult to know what to call suspects because of CPS guidelines derived from European rights. I don't really understand this but have just seen it on the CPS website.

Taken together CPS guidelines seem to set up a contradict in terms:
Only a male can rape (see previous post)
But
A male with a penis who presents as woman must be called a woman by the police.(see below)

CPS guidelines for transgender suspects
As set out in the Code for Crown Prosecutors, prosecutors must apply the principles of the European Convention on Human Rights, in accordance with the Human Rights Act 1998, at each stage of a case. Prosecutors are also bound by the duties set out in the Equality Act 2010. This is especially relevant when making decisions that impact on transgender suspects. Prosecutors should address suspects according to their presented gender by using the correct gender and pronouns in all documentation.

Prosecutors reviewing sexual offence cases involving suspects who are transgender need to be aware of, and sensitive to, all the relevant circumstances and should ensure the police supply as much information as possible in order to properly inform their decision making. For example prosecutors will need to know the suspects position in relation to the Gender Recognition Act 2004 (GRA).
