Bil has given himself whiplash on purpose

Found this out yesterday and still not sure what I should do.

Bil's car failed the mot, so he waited until someone was tailgating him slammed on the breaks and claimed a badger ran out into the road. This was fake. But the car driving too close was real and it went into him causing damage. It will cost too much to fix his car, so he's hoping to get the insurance payout for the car and a whiplash.

Its more really a wwyd?

I was thinking that too - it's shitty but I really hate tailgaters. Might teach them a lesson.

In seriousness, I do think what he's done is very wrong, but in practice I don't think I'd do anything.

Report him when you know he's lodged a claim - but as it may be tough to prove his fraudulent intent & that the badger was a fake, you may get some fallout yourself (I hope not).
Long story but we were affected by an incident like this (going through courts now) and the repercussions on the innocent party are awful - emotional, physical & financial.

Who do I report it to?

He had an mot I believe, they give you a month to fix the thing it failed on. Although I don't know what exactly it failed on.

For people saying report him- to whom? I'm struggling to imagine an insurance company taking a call like that seriously. No one else is involved.

You're supposed to report any accident with injury to the police aren't you, I think going by what you've said he's done he could be done for driving without due care. Perhaps start there?

Police and insurance company, if you know it. They will take it seriously - crash for cash scams are a massive problem.

it would depend on what it failed on,

From DVLA:

Driving a vehicle that’s failed

You can take your vehicle away if your MOT certificate is still valid.

If your MOT has run out you can take your vehicle to:

have the failed defects fixed
a pre-arranged MOT test appointment

In both cases, your vehicle still needs to meet the minimum standards of roadworthiness at all times or you can be fined

No you don't have to report it to the police. I actually tried to once and they said don't bother we won't do anything and as long as you've exchanged details all good. The police won't have anything to do with this. The tailgater is still caused the accident by driving too close.

To the police Double as if it's true, it's a crime. As someone else pointed out if Bil was injured he should have reported it to the police. Even if it's a balls ache enquiry they're still duty bound to look into it

Yes you do if there's an injury.
No injury, damage only, details exchanged, insurance companies only.
Any injury a RTC booklet should be completed. Tis true.

Tarten - unless you hate BIL and your sister don't report him! They are family and yes he's fucked up but tell him he's a wanker to his face and give him a chance to prove he won't do it again.

Insurance companies have fraud lines specifically for this purpose. They'll be extremely interested.

He is a complete idiot IMO.

My poor daughter has been in terrible pain for over a week with whiplash caused by someone driving into her. Totally not her fault.

She has had a miserable half term, she has lost her place in her sports team and the upcoming British championships.

The car is written off. We have to find an affordable second hand car within a couple of weeks. The insured loss won't cover the cost.

I have spent this week filling in forms, taking her to medical appointments and trying to bolster her spirits in the face of all our half term plans being cancelled. My one precious week off work has been ruined.

People like your BIL make it difficult for genuine victims like my dd to make legitimate claims.

the fault is with the driver behind - if you can't stop in time when someone brakes then you are too close.

but - the failed MoT WILL be picked up. Questions will be asked. This will almost certainly return to bite him in the arse. He may end up having to perjure himself in court; there aren't many with the balls to risk that.

the idea that 'they' were born yesterday is very naive.
