So just out of interest who gets the item here?

This is now resolved but just out of interest...

Shop has a large and high value item on a marked down price due to it being ex display.

Customer 1 goes over to the till to ask about it. Dithers for a bit. Doesn't place the order. Goes back over to have a look to help her decide whether to go for it or not.

In the meantime customer 2 comes to a different till and asks to purchase the item. Till operator 2 goes to get the bar code from the item.

Customer 1 then goes to the first till and says yes Ive decided I will go for it please. Till operator 1 also then walks over to get the bar code and meets Till operator 2 coming back with it.

Who gets the item customer 1 because she asked about it first or customer 2 because she actually confirmed that she wanted to purchase first?

Reebok treadmill in the place that delivers on the day? Was it £150 on top of the 50% off - bargain! We bought one and it has been used every day so still worth the money.

You should have got it. Anyway, look on the Tesco website, they have reduced all their treadmills and exercise bikes

Yes original price over £1k, 50 percent off and then another £150 off for the ex display model in the store.

Someone got a bargain (just not me!!Grin)

I would not have paid an extra 150 for it. I would definitely complain. Shop was wrong- your offer was accepted first .

The first customer who was definite about the purchase, so obviously customer 2 as their cashier had the code ticket in their hand.

If so, I think you were a wee bit cheeky to ask for it. I'd have said "if customer 1 doesn't want it, I'll have it".

In the end it might have been a relief to 1, when she got finally got home and really thought about it. If she dithered about buying a large value item which was marked down, then she may have been really stretching her finances to buy it.

Here's another one.

A lady cleared out her dec'd mother's house and gave us a bag of tangled bits of jewellery, mostly obviously junky stuff, for us to sell on our charity stall at the summer fair.

I was given the job of sorting and pricing it. In with the junk there was a string of pearls. I thought they probably were the real deal, did the 'tooth test' (real pearls feel gritty, false ones are smooth) and this, together with them being individually knotted,made me think they'd probably got some value.

So I called on a jewellery valuer friend we have, for an estimate.

Bottom line, he put a price of approx £600 on themShock

Now, should we have a) returned them to the donor explaining that they were the real deal and had substantial value, or b) thought we were given them so they were ours to sell and said nothing ?

This is madness. It was clearly you who should have got it. The CCTV thing is ridiculous. The assistant should have been able to explain that customer 1 hadn't asked to buy it.

I'd definitely complain.

It clearly didn't prove what had happened because it had no sound!

I wasn't there when customer 1 enquired about it. I know what happened because when I was (I thought) in the middle of buying it, the conversation at the next till was

"have you decided?"

"yes I think we are going to go for it."

"are you sure?"

"yes he wants it"

By this time I was waiting for the sales assistant to come back.

I didn't deliberately rush up to the till when I knew customiser 1 was interested. I did see her walking towards the item as I was leaving the item to go over to the till.

Oh if you didn't know customer 1 wanted it, then you should have got it. If this had been done over the Internet, you would have pressed BUY before her and you would have got it!

Jonquil I would have have given them back to the woman- they belonged to her mum so she should have had the money. I think you'd be on a sticky wicket law wise if you didn't return them, as the woman gave them to you thinking they were "junk". When you found out they weren't you should inform her.

Although legally the pearls are yours and were a gift to you to sell on etc, I personally would give them back to the donor.

I would contact the company. Before I read your update and knew you were #2, I was going to say #2 should get it.

You would be surprised at what merchants can do if they are motivated. I went in to buy a TV last year and had the wrong info about the start date of the sale.

The manager came by and she ended up (without my asking) authorizing the sale price, and for a nicer TV! I was pleased and impressed. Don't buy your treadmill till you test their customer service ethic.

  1. Customer 2 confirmed they wanted it. customer 1 dithered. If you cant make your mind up then tough.

However, if customer 2 KNEW that customer 1 was thinking about it and delibrately snatched it before she had the chance to complete her deliberations, it makes customer 2 look pretty selfish though technically it's still their win

Morally the pearls should be returned. Hopefully the daughter will offer something but it's better to do the right thing.

Customer 2. It's not sold until it goes through the till, which Customer 2 beat Customer 1 at doing.
