Or not to leave?

I've namechanged for this for obvious reasons....

I work part time in a sales role. We are all self employed and get paid on a commission only basis. We all have to rely on the bosses being truthful and honest about what sales we have had as we are not allowed access to any of the final sales documents each week.

All has been ok so far, and I've earned a decent amount each month. However in the past 3 months things have changed.

Firstly a new person started. He is an old schoolfriend of the main boss. He is being paid double the commission that the rest of us are being paid, and being given a load of ready-made sales each week that used to get split between the rest of us. He now gets them all. He is earning between 5 and 10 times each month what the rest of us earn. This bloke is also a complete bully and has already bullied two colleagues out of the job by demanding that the boss sacked one, and being so nasty to the other.

I don't feel that our bosses are being honest about earnings any longer; I have had a few weeks now with nothing of mine going ahead, however I got suspicious and phoned a few customers that had supposedly cancelled but they had not cancelled.

DH thinks I should leave and I am fortunate that we do not need my income, and I do have a business idea that I would like to start. However I generally enjoy having a 'work life' and don't want to not go to work, if that makes sense?

I doubt that the situation will improve where you currently work.

Perhaps spend some time exploring your own new business idea and getting it off the ground, then leave?

Could you ask for greater transparency? You could sell it as a motivational idea to encourage sales staff?
Working for free for weeks sounds rubbish though.

If you don't think there's any chance of things improving and it's not possible to speak to your boss about it then yes, I would leave. I'd be tempted to tell them exactly why you're going.

It sounds very dodgy.

Leave, and report to HMRC - they is a good chance your employer is breaking the law on what constitutes self employment.

If you have evidence that you have not been paid commission for sales you made, then you could try getting they money back through the small claims process.

Goodness me leave them and also take them to court for money owed if you have the inclination.
