to think my work needs to actually tell me if im getting maternity pay or not?

Basically my work has told me nothing, i sent my matb1 form to them when i was 20w pregnant, im now 31 weeks and had no info. Boss no help so rang HR. HR have been just as useless and said something should have been sent...i rang again and got told nothing had been sent and would be asap. Fast forward a week i rang them again and the HR rep was very laid back and just said 'oh yeah I'll send it to you soon'. I only work 16h a week and have been off ill so not sure if i will even qualify for maternity pay from them, and as I've waited I'm late on applying for maternity allowance if i need to do so. Should i just keep waiting or make a complaint? Not really sure what to do and pretty pissed off!

www.gov.uk/maternity-pay-leave/pay You should be able to work it out for yourself here. You have given them the correct notice. They should have replied to you within 28 days, so you have grounds for complaint.

Only thing is i worked it out on that and going by my contracted hours i dont qualify...but HR said they take it from what ive earned over last few months?

It's what u earn in the qualifying weeks if u look up rules it will tell u how many weeks to count back from date on matb1

It is fairly easy to work out whether you can claim Smp. Generally speaking if you were employed with that employer at the time of conception and earn over £112 pw you should qualify for Smp. www.gov.uk/maternity-pay-leave/eligibility

You would then get 6 weeks at 90% of your average actual pay over the qualifying period or the Smp rate whichever is higher, followed by 33 weeks at Smp.

Im 31 weeks pregnant, past 8 weeks ive been off ill with preg related illness so just got sick pay for my 16 contracted hours a week (so about £330 a month). Before this i was earning between 500-900 a month depending on what shifts they gave me (no consistency)

The qualifying period is roughly weeks 16-24, so even if you were off sick for a week or 2 the average you were actually paid should mean you are ok. Have a look at your pay slips for that period. Iiwy I'd make my own calculations and tell them that you believe you are entitled to Smp. Are you due to return again before ml or are you having to start it now?
