To report my boss.

I am the sick due to having magor knee surgery. I can not walk unaided and have not been out at all.

Tonight I went out with friends for a meal. I did not drink any thing other than soft drink.

I saw my boss out and she basically said if I'm well enough to go out then I should be at work.

I'm a cleaner and I am on crutches I can even clean my own home.

Forget about it for the weekend then speak to HR on Monday

There is a world of difference between sitting on your bum eating a meal and cleaning a hospital ward

Your boss can jog on

That's ridiculous. Not sure who yyou'd report her to though. HR? It's not exactly managing your recovery supportively and I take it you've submitted a medical certificate.

Oh, I wasnt aware that when you are recovering, you're housebound. Jeez you had surgery, you arent contagious, you're allowed to go out.

I'd report her.

I had an operation and was told a minimum 3 months off been off 5 weeks.

I had a taxi there and back and the lovely staff came over took the order and bought the card machine over.

Email HR, put it in writing. She shouldn't be talking to you about work when you are off sick from it- she especially shouldn't be talking like that.

I am floored she has been supportive.

I did apply for a job today, I don't think she would know yet.

Your boss is out of order, as other posters have said there is a world of difference between being able to go for a meal and being able to go to work, it would be different if you were off sick with apparent flu for a couple of days ( ie taking the piss) and she saw you out having a meal but she can't expect you to be housebound for 3 months following major surgery?

When I had my last major surgery my boss encouraged me to go out for my own sanity when I was able to as she knew I'd really really struggle staying in the house every day , plus my physio told me I needed to walk somewhere dry, safe and with people around incase I fell the only place suitable was a local shopping centre when I rang and explained to my boss she thought I was daft for telling her as it wouldn't have been a problem. Having a supportive boss makes a big difference.

Speaking as HR... I think you need to send an unemotional message to your boss first, explaining that you are signed off as sick and still not able to work however you can get out and about a bit and it helps your recovery to do so. And you appreciate her understanding at this time and don't appreciate any suggestion of anything else. Keep it simple, and to her. Reporting her to someone else at this point might not help - just antagonise her and this way if you need future come-backs you have a record of raising your concern, stateing your case and trying to deal with it quickly and to her.

Your boss could get in trouble here as it's against the law to talk to employee in this way when on sick. At least that's what I was led to believe by my lovely boss when one of our collegues had a breakdown (linked to personal reasons not work) I wanted to send a card saying get well soon and was advised that whilst it was a nice thought it was not allowed. Boss said it very hard as we wanted to be there for her but couldn't as it was up to her to contact work. I'm sure some legal person will advise. Meanwhile draft a letter to hr. Hope the pain goes soon and your knee recovers quickly. X
