Our solicitor told us everything was in place for exchange today but it turns out he hadn't checked for our deposit, or asked us to transfer it to him. Appears to be no big deal, exchange couldn't go ahead but will go ahead next week and no legal problem as far as I can see, though embarrassing that we held up a chain of four. He has acted for us loads without a hitch in past.AIBU to be a bit unnerved or does this happen sometimes?

It happened to me, everything went through fine a couple of days later.

Shit happens, solicitors are also human, despite sometimes appearing undead*, and occasional mistakes will occur. I hope he grovelled.

*I am a non-practising solicitor & say this with the greatest love to my former colleagues…

Just make sure you are on his mind a week or so before completion by calling/ emailing a few times so that he requests the mortgage monies in good time.

MrsDe · 30/05/2014 20:23

Weren't you aware that you hadn't transferred the deposit?

Eatriskier · 30/05/2014 21:16

The solicitor at the bottom of the chain of my parents last house move lost the deposit they were given. It more common than you'd think. They all got sorted in the end.

We have just remortgaged and our solicitor paid the money in to the wrong account. We had to wait until they recalled the money then paid it in to the correct account. Its a good job we weren't buying as the whole chain would have collapsed!

I would remind him a lot at every stage

Thanks to all of you. Feeling reassured. He is a good conveyance rand I guess these things happen. We have been mad busy and so didn't click. Dddhhh. Anyway, fingers crossed. Thanks again.

Our vendors Solicitor lost the contract. It wasn't a massive problem but very embarrassing for them.
