To ask my employers to pay for my phone repair?

I slipped on ice at work yesterday and my iPhone 5 that was in my jacket pocket is completely smashed . It's insured but it's £100 excess .

I ended up having to get sent home from work as my back was so sore from the fall . My colleagues have said that as it was an accident in the workplace (I have filled out an accident report form and forwarded it to my manager) that the company should cover the cost of the phone repair ?

I spoke to my boss but she didn't take me on at all . Was I being unreasonable ? Would I be unreasonable to contact my HR or H&S dept regarding the damage ? (Is try my boss first again I think)

If the liability is for negligence, and not for a breach of section 41(1) of the Highways Act 1980, there may also be liability under the Occupiers' Liability Act 1957. This Act imposes a different duty and a different standard from the Highways Act 1980. The occupier of shops, offices, car parks and similar places will have a far greater obligation to take such care as is reasonable in all the circumstances for the safety of visitors.

I think you do have a case, but me personally wouldn't cliam against my employer as it would damage work relations.

The OP hasn't asked if she should sue. She's asked if she would be unreasonable to ask her work. I can't see how asking would be unreasonable if they are legally responsible. If they say no then the OP would need to consider whether she wants to take it further, then the fact that the loss is small (not clear it's £100 - OP only said that was her insurance excess, not that that was the cost of fixing the phone) compared to the cost of action becomes a bigger factor in her decision making.

Paying for the phone, even a small amount of £100 will be admitting liability.

So HadA? Companies do sometimes pay out when they are liable. I've had employers reimburse me for losses incurred while working. I didn't sue or threaten to sue, I just asked them. They paid.
