To want to slate this seller all over e-bay?

I ordered two new ds consoles on e-bay on the 21st November. The delivery time was around five days. They were supposed to be my two sons main christmas presents. On December 12th I opened a case and e-mailed the seller to say that they hadn't arrived. The seller wrote back to say that they would refund me. They haven't. I've written another e-mail saying I'm very unhappy as I left plenty of time to receive my order, it still hasn't come and I also haven't received my refund as promised. No answer. It's like the seller has just disappeared.

What shall I do? I'm so gutted. Not only do I have really disappointed sons to deal with, I'm also seriously out of pocket too :-(

Did you escalate your case to eBay? When you escalate, eBay (rather than the seller) take control of the situation and normally refund you quickly in this kind of situation. You only get 20 days after opening the case to escalate, so try that now.

Open a dispute with ebay. You should be covered through PayPal. If not dispute with the card you used.

Oh and slate on ebay, if they are legit they won't want the negative feedback

You will definitely be covered by ebay buyer protection, but you need to get on with escalating the case. I would never wait 3 weeks myself before opening a case, & if I didn't get a refund pronto I'd be moving to the next stage. Ebay will sort it out for you & force a refund, but don't leave it any longer!

Ok thank you people. How do I escalate the case? I've never really bought or sold much on e-bay before.
