AIBU re Ebay

Sold a car on Ebay last night

Buyer rings me this morning and says he doesn't want / can't come and get it or pay for it until next weekend.

That's not great as we were selling it as we need the cash.

I contacted him again and said, look sorry but we have someone who wants to buy it this weekend and we need the money. I know you bought it on Ebay but you aren't willing to pay for it for over a week and that just doesn't work for us.

AIBU? He is now hounding me with calls, texts and voicemails kicking off that he has sold his car on the back of buying ours

I can appreciate it's not ideal for him, but if you buy something I don't think not wanting to pay for it for 8 days is ideal for us either

Am I being totally U by going back on the Ebay sale or is he for buying something he can't pay for for over a week?

Did you say in your advert that it needed to be collected and paid for this weekend?

BlueGoddess · 21/09/2013 11:31

In all honesty, I'm sorry but yes I think YABU. A car needs insuring and so I. Before it can be taken away, it needs a little more planning on collecting it, and they need to get the money together, so I think a week is a reasonable time scale.

Caitycat · 21/09/2013 11:31

I know this is really irritating for you but I think you probably should have put that you needed payment within x days of the end of the auction. I think the buyer is being a bit unreasonable but not sure it's unreasonable enough for you to refuse to sell. Perhaps you should repost this in the eBay topic if you don't get much response here as there are people there with loads of experience.

catgirl1976 · 21/09/2013 11:39

Yeah I'm a bit torn

He's just been so arsey from the get go. I didn't state we wanted the sale completing within xx days (which I accept I should have done) but over a week seems a bit excessive. It takes 10 minute to sort out insurance on the internet.

BlueGoddess · 21/09/2013 11:43

Thinking about it, they could well be waiting for wages at the end of the month too

catgirl1976 · 21/09/2013 11:47

Aren't we all Blue :)

I guess I am being unreasonable and will go back to him and tell him I will wait till next Sunday :(

I don't think yabu but think you probably should have stated in tje ad that you wanted it paid for etc within a timescale.
I recently bought something on ebay and contacted the seller to check if okay to bid as was going on holiday so couldn't collect until after.
imho I think he should have okay'ed it with you first.

catgirl1976 · 21/09/2013 11:50

Btw It's a very cheap car - it's under £500 so its not like someone would be trying to sort out financing like for a £10k car or anything

ILetHimKeep20Quid · 21/09/2013 11:50

Nah yanbu, tell him to bolt.

Insurance take a seconds, you don't bid on something if you can't pay for it.

pianodoodle · 21/09/2013 11:50

*When a buyer wins an item or uses Buy It Now to purchase an item, the buyer is obligated to complete the purchase by sending full payment to the seller.

If a buyer doesn't pay within 2 days, a seller can open an unpaid item case in the Resolution Center. If the buyer still doesn't pay or reach some other agreement with the seller, eBay may record the unpaid item on the buyer's account.*

Found this on the rules page - may be helpful!

kali110 · 21/09/2013 11:51

I would expect payment within few days however not big things like a car.if they're paying cash in hand then if they cant come to collect for a week then maybe that would have been acceptable.
Think you should have stated in your ad when you wanted payment.think you may aswel wait for the week just to save the trouble!

kali110 · 21/09/2013 11:53

Pianodoodle most people who buy cars from ebay pay cash on collection for safety.

catgirl1976 · 21/09/2013 11:55

Thanks everyone

Those rules are helpful Piano

I wouldn't expect anyone to send paypal for buying a car and would always expect cash on collection but it seems like 2 days is the rules so I am not being technically U

Realistically, sine the majority think I am being U anyway i will honour the agreement

No birthday treats for me....boo :(

I think the buyer is unreasonable here, you don't commit to buy anything if you can't complete the within a reasonable time, and I don't think eight days is good enough. He should've given you a chance to tell him no before the auction ended. The fact he didn't shows he probably knew you'd say no.

I would perhaps tell him you will give him three days grace period, but if he's still insisting on eight days, I'd sell elsewhere.

TidyDancer · 21/09/2013 12:21

Complete the sale, is what I meant in the first sentence!

catgirl1976 · 21/09/2013 12:22

I'm wavering now as the consensus is a bit more balanced.

He has been such an arse I now am re-thinking it.

OP posts:
geekgal · 21/09/2013 12:41

I'm going to vote for the buyer being unreasonable - I've sold a few cars ( not on eBay ) but I would expect once the deal is done for the timescale to be a couple of days at most, this is over a week! You don't commit to buy unless you have the funds, and he has admitted he doesn't have the funds, that's pretty clear cut really!

DamnBamboo · 21/09/2013 12:41

Were you expecting him to show up and pay for it and take it away this weekend? Bearing in mind if it was via bidding he didn't even know he was going to win it.

Do you really have another buyer for it?

Unless you stipulate a time-frame for payment, then it's not worth moaning about. He doesn't sound as if he's been U at all.

If you open a case, you'd have to prove that he was being obstructive and wasn't communicating with you - which isn't the case here.

I think YABU.

geekgal · 21/09/2013 12:43

Oh and if you need to wait for pay day or a cleared cheque you ok that first, I've asked people to wait occasionally but that was ALWAYS before committing to buy and I've never held it against them if they then say they can't, that's fair enough...

DamnBamboo · 21/09/2013 12:44

Was it a buy it now or an auction?

Chippednailvarnish · 21/09/2013 12:45

Send him a copy of the rules and then tell him to go and jump...

kali110 · 21/09/2013 12:46

It does depend where the buyers coming from. If he didnt know he was going to win it it may take a week to sort ouy how to get there and who was going to drive it back.im normally saying the buyer would be in wrong, however to go pick car up may take few days to sort collection.

ihearsounds · 21/09/2013 13:11

You haven't got the money, you don't bid.
He is saying he has now sold his car on the back of buying your car. Well he can use that money to come get this car.
What happens in a weeks time when he still hasn't got his stuff sorted and still short? Wait another week.

He should have thought about finding cash first.

catgirl1976 · 21/09/2013 13:11

It was Buy It Now for £500 with the option to make a Best Offer

He offered £450 and I accepted for a quick sale which is really why I am annoyed. I in effect ended the listing early on the strength of his offer but he doesn't currently have the funds to have made it

It's also SORNed atm and he asked me to stick 6 months tax on it and he would give me the cash for that when he collected which is an extra risk if he doesn't turn up or changes his mind

OP posts:
Doubtfuldaphne · 21/09/2013 13:16

I think if you said buyer must pay within 2 days of auction ending then it would've been a lot easier
Talk to ebay - if they say you'll be covered by the rules theb go with the other buyer. Tough shit if he gets annoyed. Those rules are pure gold!
