To think that you don't sell a pushchair covered in food, mould & god knows what else

Bought a pushchair today which was described as
'In good condition with the usual scratches, there's a bolt that needs tightening'

Sent OH off to collect it

On his return we notice

  • the cable is snapped so bolt can't tighten
  • it's covered in old dried food, dust, mould & lots of other unpleasant things

I emailed the woman to ask for a refund but she states no it was ok and usable when it left but then changed her mind saying that she would have it back

I explained that my OH had to dismantle the thing to attempt to tighten the bolt & I would be returning it all as it currently is.

She won't accept it back

Who's being unreasonable

If you're taking it back I think you really should put it back together again.

If the seller was being kind they'd take it back but I can see why she changed her mind when you said it's in bits.

Tbh the person at fault here is your OH - he shouldn't have paid and taken it away covered in food and crap.

I think you should not really have dismantled it before asking to return it. I would have wanted my money back after having found mould.
Is there no way you can rebuild it in order to get your money back?

In all fairness, you should always examine before paying. She can just say sold as seen. What did the emails say exactly?

You could argue that as cable is snapped so you can't tighten the bolt, its not fit for purpose. Get DH to reassemble to return it to her. How much did she charge BTW? If not much, chalk it down to experience.

It can be rebuilt but I can't be bothered wasting any more time on it.

OH said that the woman met him on the drive with it and rushed him to the car saying she needed to go out asap so he didn't get the chance to look.

Sorry but your OH shouldn't have paid then. I wouldn't accept something I didn't have time to look at.

Can you afford to lose £100? I couldn't...I'd put it back together.

Put it back together, and get your money back.
Or don't bother and loose £100. You are lucky she isn't saying "sold as seen" TBH.

YANBU to want a refund.
YABU to refuse to put it back together.

Put it back together and get the refund. If you don't want to put it back together you can't reasonably expect her to refund you.
