Broken rib - claim?

Just been to the dr today who suspects I have a broken rib. About six weeks ago, one of those mini-van people carrying things that they use in stations reversed out of a lift at Manchester picadilly and smacked into my side. I was standing trying to text my friend in an open, indoor area for pedestrians. I has 2 small kids with me, luckily I was hit before the pushchair could be.

So, the driver shouted at me for not looking (quite why i should look around me when standing still, inside..... well there was no reason.)I shouted at him for not looking before reversing out, at some speed. A bystander intervened and stood up for me, also gave me her address in case I was badly hurt.

The driver buggered off, and I stood there trying to get it together. Eventually he came back after dropping off the passengers and said I looked pale, was I ok. Still didn't apologise. To get rid of him, I said don't worry, I'm not going to report it.

Now I kind of want to, since I have been in pain, and doc suspects fracture. But I no longer have the bystanders address. Is it worth it? Should I stay out of the component culture? Thoughts?

well do you have any details at all?

I would probably leave it after this amount of time

After al this time you'd have trouble proving anything conclusively

Only details are the time and date.... I guess there cd be CCTV?

You were stood in the way of the lift and weren't looking at it though...it's a bit like standing behind a door and then getting annoyed because someone opens it;

I wasn't in the way of it, I was quite far away. I don't think anyone expects a big vehicle to zoom out of a lift in an indoor building, and he needed a buzzer or something, he was reversing so couldn't see a thing.

Have you had to take time off work or lost earnings? Despite the assumption that compo claims are a free for all it's really not worth it unless you can prove some kind of financial loss on your part.

This was at manchester picadilly? Did you report to staff, to put in the accident book at the time? Any.other verification - say presenting at a and e the day of the collision?

No, no. I just cal,ed myself down and went off. I was a bit shocked,tbh. Shock and embarrassment are big factors in personal injury claims.

You should have reported it to the centre at the time!!

If you had, the would have filled an incident report and looked at ways to make this safer in future, for a start installing a reversing beeper on the vehicle. Imagine if he does it again and runs into a stroller or child!

You could try reporting now as a follow up. I wouldn't think you could sue unless you are out of pocket for your injury.

You may well find that CCTV has already been recorded over. It typically loops so that after four weeks, the data is overwritten.

I think it could be said that if you have managed for 6 weeks, then nothing is THAT bad enough to make a belated claim.

I've managed. He was just such a tit, and now to find out I actually was injured.....

Well, maybe I should write to the station master (or equivalent) and let them know so they can be more careful. At the time, I just wanted to get to my friends and have a cry!

tbh sounds like you were partly to blame for not looking if you were stood near a lift it would make sense to be slightly observant surely?

I agree after 6 weeks doesn't seem like you have any grounds for a claim. I would imagine their first statement would be "prove it was us" and you couldn't

Obviously I was slightly observant, as I always am when I have my children with me. I was a good 20 meters from the lift. He just went way too fast.

Why on earth would you make a claim?! If it's taken you 6 bloody weeks to go to the docs then it's clearly not tht bad and you haven't lost any earnings!

These things are a menace. I'm with the OP. And I don't think 6 weeks is that long. I don't think she can be blamed for not looking if she was standing still.

If you didn't need medical attention at the time or at least very soon afterwards, you have next to no details, and you didn't incur a financial loss, you are unlikely to get anywhere with a claim.

It sounds to me like he was at fault though, and you were generous in not making a complaint at the time.

If he drove straight out then she was standing in the way ragrdless of it being 20m...why didn't you stand to the side?

If you were texting you weren't being observant.
I understand you were indoors and weren't expecting to be run over Grin, but I really can't see why you want to claim.

1.) You were texting, so not being observant.

2.) You have no medical evidence from straight after or very soon after.

3.) What have you actually lost that requires financial compensation?
