To ask for the money to repair my scratched car?

Yes, I know I was in the wrong to some extent....I was parked just on the zig zaggy bit, in a rush waiting for DD to come out of school. Old lady drives past, knocks wing mirror and pulls into her driveway leaving the cover of her wing mirror in the road. She then had a rant at me as I shouldn't have been parked there and I've just gone back to my car to see the back wing all scraped by her wing mirror. Should I go to her house and ask her to pay, I've a feeling she'll just give me another mouthful, DH will be sooo mad at me later

You parked in the wrong place, OP. fair enough, you have admitted that and been verbally whipped for that plenty on here. The woman hitting your car is an entirely different issue. As I understand it, driving involves the use of eyes and spatial awareness. If the woman couldn't get round your car, she should not have tried. She would have been completely justified in giving you a piece of get mind about how she couldn't get onto her drive, but she either needed to judge that she could get round you - and then do that without scraping anything- or decide that she couldn't. She was in the wrong when she hit you. I don't drive along reacting to what the traffic 'should' be doing, I react to the actual situation. I fail to see how you being parked in the wrong place made her hit you.

As said above, she is liable for the damage. Even if you had parked in the middle of the road she would have been in the wrong to hit you."

I'd imagine that there'd be a percentage of contributary negligence assigned though if the op were to pursue any legal action

You were wrongly parked, she wrongly assumed and tried to pass you and hit you.

As far as I know, it doesn't invalidate your insurance despite being illegally parked BUT accidents are meant to be reported to the police within 48 hours, no matter how minor and your insurance company may well pass details on to them which could lead to you being fined and given penalty points as a result.

You can ask her to pay but knowing the above and having to (likely) deal with badly parked and driving car peeps, she will probably tell you no.

Your husband will probably be annoyed you were parked there but will he pitch a fit about that or about you not asking her to pay?
