To ask for the money to repair my scratched car?

Yes, I know I was in the wrong to some extent....I was parked just on the zig zaggy bit, in a rush waiting for DD to come out of school. Old lady drives past, knocks wing mirror and pulls into her driveway leaving the cover of her wing mirror in the road. She then had a rant at me as I shouldn't have been parked there and I've just gone back to my car to see the back wing all scraped by her wing mirror. Should I go to her house and ask her to pay, I've a feeling she'll just give me another mouthful, DH will be sooo mad at me later

You were wrongly parked, she wrongly assumed and tried to pass you and hit you.

As far as I know, it doesn't invalidate your insurance despite being illegally parked BUT accidents are meant to be reported to the police within 48 hours, no matter how minor and your insurance company may well pass details on to them which could lead to you being fined and given penalty points as a result.

You can ask her to pay but knowing the above and having to (likely) deal with badly parked and driving car peeps, she will probably tell you no.

Your husband will probably be annoyed you were parked there but will he pitch a fit about that or about you not asking her to pay?

I'd imagine that there'd be a percentage of contributary negligence assigned though if the op were to pursue any legal action

You parked in the wrong place, OP. fair enough, you have admitted that and been verbally whipped for that plenty on here. The woman hitting your car is an entirely different issue. As I understand it, driving involves the use of eyes and spatial awareness. If the woman couldn't get round your car, she should not have tried. She would have been completely justified in giving you a piece of get mind about how she couldn't get onto her drive, but she either needed to judge that she could get round you - and then do that without scraping anything- or decide that she couldn't. She was in the wrong when she hit you. I don't drive along reacting to what the traffic 'should' be doing, I react to the actual situation. I fail to see how you being parked in the wrong place made her hit you.

My DM lives opposite the zig zag yellow lines of a local school. When she reversed into a car illegally parked on them she was still liable for the damage. As although a car is illegally parked, in a moving car driving into a stationary car accident, the moving car is alway to blame.

It didn't stop me pointing out to the people sitting in the parked car that they were parked illegally though.

Hitting a stationary vehicle whilst moving is more of a civil type of offence . ( no police need to be involved , its between you and the thrird party ( unless there is an injury))
Illegal parking on a highway , Has to be a Policeman or Traffic warden so more criminal hence the potentila fine .

I would be wary of going through the insurance . I am almost certain , even though you are not at fault ( stationary ) it can affect your future premiums .

as to the poster who 's neighbours car got hit at night as it jutted out into the road, You are supposed to park in the direction of travel so your rear reflectors show your vehicle clearly . By parking sticking out he was contraveaning a traffic reg .

bummer , car repairs are costly and its chrimbo , but sounds like 'Dentmaster ' or somesuch could repair the panel easily enough. Have a look at 'Chips away' as they are similar and do just the local area to the damage for less than a night out . hth . good luck.

I would certainly ask her to pay for any damage caused to your vehicle even though you were parked illegally. Whatever happened to 'two wrongs don't make a right.' She damaged your vehicle while you were stationary, so she should pay for the damage. You shouldn't have parked illegally and would have had to face the penalty for doing so if you had been caught but that doesn't mean you should just have to accept that someone else has scraped your car.

The penalty for parking illegally and damaging someone's car are two entirely separate matters.

I don't think it was difficult she didn't quite make it, I could see her coming in the mirror and though oh, S* her driveway was lower down.
Lesson learned, you can all stop having a go at me, I've beat myself up anyhow.

Sorry It's a bit unlike me to call anyone a bitch, didn't mean to offend, I'm a little upset, no excuses though, she was very posh though and I kind thought that she did it all the time as it didn't bother her in the slightest, and to be fair there was plenty of room she was a poor driver TBH.

I have a white line painted over my drive to stop people parking over the end of it. Idiot over the road keeps parking his huge van (bigger than a Transit) so its over the white line but not quite over my drive.

It makes it nearly impossible to get into my drive if I come along the street in one direction and very difficult from the other.

I've moaned at him several times and he says sorry and moves it. I've warned him that one day I'll end up hitting his van as I try to get into my drive if he keeps doing it.

It does sound like you made it difficult for her to get in her drive. So no, even though legally you might be in the right I think it would be unreasonable to ask her for money. Think of it as karma.

Tell your insurer and give them her registration number and see what they make of it.
I'm not entirely sure why a car parked illegally can be treated like a dodgem, but then I'm not a driver.

FWIW OP, this is the sort of thing I would do then instantly regret when it backfires. I'm sorry your car got scratched and your DH will blame you.
I just didn't like the way you accused the lady of doing it purposefully, and calling her 'old' and 'bitch'.
I'm sorry I came on a bit strong, and sorry if you feel attacked.

There were no kids around (I wouldn't have been there otherwise) I know that doesn't make it OK though, and I am mad as I normally park in another road nearby.

But you only feel bad because your dh is going yo be pissed off and your car is damaged.

You should feel bad because ignored rules put their for own childrens saftey and their friends saftey.

No one caught hurt, so feel a bit daft and don't park there again.

Put head teacher has been known to stand outside school and knock on car windows of people driving stupidly (when they stop) or park illegally and ask them very loudly it they know they are putting their kids in danger.

Makes me chuckle. The police have also attendee and done this. We rarely have issues now.

Perhaps your school should do something similar since its sounds like a lot do itm

actually you can't just park in the middle of the road and have the blame removed.

One of our neighbours parks with the back of the car in the road if he can't find a space big enough. His car got hit the other night, he wasn't covered by his own insurance and the other insurance company wouldn't pay out so he is now car-less.

from what he said, the police and insurance companies said that his actions contributed to the accident.

As said above, she is liable for the damage. Even if you had parked in the middle of the road she would have been in the wrong to hit you.

However I also agree that you should suck it up. A lesson learned.

Oh I can't bloody believe you guys - you really think that it is reasonable to smash a car up by driving into it because it is illegally parked. Can you imagine if someone came on here saying a car was parked partly across their drive and on yellow lines or zigzags and so they smashed into it and hurt one of the occupants - would you all be going - well done, good on you, shouldn't have been parked there anyway???

No matter where someone is parked it is never right to drive into another car on purpose.

If op hadn't been parked illegally/dangerously then nine of this would have happened.

Perhaps the old lady/bitch should have pulled up and waited patiently until op returned to move her car. But she obviously thought she could squeeze round, which was her mistake.
