to think this Ebay seller is a deranged twat?

Long story short, she sold me some 'excellent condition, hardly any wear' boots for £50.

They arrived and have green paint on both boots, which someone has made a half arsed job of removing. They were photographed for the listing in a way that meant you couldn't see the affected side of each boot Angry Its still really noticeable (pic on profile) and there is also damage to the lining of one. I opened a dispute as she refused to discuss it privately Hmm Returning them will cost £24.50 by Special Delivery (which is the service she asked me to use) so I told her I'd send them back by Collect+.

She has replied all shoutily with loads of capitals, telling me that Collect+ is not an acceptable service, she won't refund unless I send it by a service she considers acceptable, there was no paint but even if there was it should be expected on used items, and that I had no right to open a dispute and cause "all this aggreviation", oh and that she doesn't appreciate me accusing her of lying.

I just now she is not going to refund me whatever I do and am RAGING as they were bought with some birthday money and were a rare treat.

Did you use PayPal? Open a dispute with them and copy them an eBay on her messages.

Did you pay by Paypal? If so, and if eBay agree with you (which is likely) they'll refund you anyway - the money will be frozen in her Paypal account and then returned to you.

If you've opened a dispute PayPal will already be holding the money. Send them back however you like (as long as insured and tracked) and sod her. I hate people who lie in eBay.

eBay are very pro buyer and I would be very shocked if you didn't get your money back

You can't open a PayPal dispute for an Ebay item. If you try, it takes you to the Ebay dispute page, which I'm already doing but will take days and no idea if I will get a refund or not because her attitude is so bad and she is blatantly a big fat liar Angry

Don't do anything else until you have spoken to e-bay.

Go from customer support on the top right of the scrren and then click the relevant things, it will give you an number so you can call them.

Explain that the seller is being obstructive and abusive and you need support to sort out the problem. Don't take no for an answer.

It is really noticable,seller is a twat and is trying it on.

Paypal will refund you without you needing to return the boots if you keep at it.

It won't be down to her whether you are refunded or not, e-bay will take the money. Did you open the dispute as 'item not as described'?

You should be refunded for the boots and ALL the postage, more fool her if she wants them sending the most expensive way.

Spoke to Ebay this morning, they said I had to wait til the 20th and then I could escalate the claim.

I am really worrie about returning them now as she is being so obstructive I fear she will claim they never arrived or refuse to sign or them or say I caused the damage or something. She's saying it has to be Special Delivery else there is no guarantee they'll arrive and she has barraged me with shouty emails since I opened the dispute.

And yes, agree with Erik, the most likely outcome at this rate is you will end up with all your money back and the boots.

From ebay:
Does the buyer have to return the original item? Who pays for return postage?
The buyer must return the item to you to qualify for a refund. The buyer will pay for return postage.
Here are the criteria for return postage:

Buyers must return the item using trackable postage with delivery confirmation, or risk not qualifying for a refund if the item is lost in transit.

If tracking or delivery confirmation is not provided by the buyer returning the item, and the item does not appear in a reasonable amount of time, then the seller is not obligated to refund the buyer.

Don't return the boots yet- get advice from eBay first. As you say, she will claim they never arrived.

Oh don't return them NO! She will most probably deny you sent them...keep them and keep disputing her method of return that she insists on and then escalate on the 20th.

Try someone like parcel monkey once you have to return them- fully tracked courier options, and prob only about 6 quid. If you think she won't sign then if I were you, I would be tempted to tell her you are using special delivery, then pack them in a bigger box so it is not obvious they are the boots, and use a courier.

I say emails, but I mean Ebay messages, so I guess they will be able to see them? She's not exactly abusive, just SHOUTY and A BIT MAD...

I'm going to advise you to not send them back and to keep the boots and leave a negative.

I bought a necklace from Ebay listed as an antique, described by the seller in emails to Paypal as guaranteed authentically Art Nouveau from 1905 and in the listing as antique - it was a cheap knock off. Paypal would not refund, Ebay would not help - they wouldn't even give me her address to claim against the small claims court from her.

I raised it as high as it could go. I ended up having to keep it and just left negative feedback.

The seller was horrible and gleeful when she got to keep my £105.
