to think this Ebay seller is a deranged twat?

Long story short, she sold me some 'excellent condition, hardly any wear' boots for £50.

They arrived and have green paint on both boots, which someone has made a half arsed job of removing. They were photographed for the listing in a way that meant you couldn't see the affected side of each boot Angry Its still really noticeable (pic on profile) and there is also damage to the lining of one. I opened a dispute as she refused to discuss it privately Hmm Returning them will cost £24.50 by Special Delivery (which is the service she asked me to use) so I told her I'd send them back by Collect+.

She has replied all shoutily with loads of capitals, telling me that Collect+ is not an acceptable service, she won't refund unless I send it by a service she considers acceptable, there was no paint but even if there was it should be expected on used items, and that I had no right to open a dispute and cause "all this aggreviation", oh and that she doesn't appreciate me accusing her of lying.

I just now she is not going to refund me whatever I do and am RAGING as they were bought with some birthday money and were a rare treat.

I did have the total opposite experience recently though, bought a dress that was not as described, seller wouldn't do anything, opened a dispute, esculated, ended up with all my money back and the dress.

I have had a good result when I opened a dispute too, got my money back without having to return the item :)

She's just replied again telling me to send them asap and that Collect+ is acceptable after all. She says I will get a refund when she has checked them against her photos to make sure they are in the condition she sent them in Hmm

Just send them, make sure its tracked and then you will probably get your money whatever. She is backing down so obviously knows she is wrong.

contact ebay customer service - they are v good IMO.
I sell privatly (baby clothes etc) but also sell thing for our business as well
Any issues we have had before about this has been resolved v qwuickly and efficently.
If I were you I would call them and tell them what she has said - keep all emails and then go from there.

PAyPAl can also issue refunds as well.
Good luck - £24.50 is extortionate. you should be able to do fedex for about £8! Or signed for RM service?

Hahahahaaaa she now says that Collect+ is too slow for her liking (3-5 days FFS, pretty standard!) and so my refund will be significantly delayed unless I choose a faster service.

The refund will only be delayed for as long as takes the parcel to get to her.

You give tracking number to ebay, and once the tracking shows she has received it ebay will refund, not her.

I have only ever had one thing on ebay that was not as described.

I opened a dispute to which the seller never responded, Paypal refunded me fully and i never had to return the item.

I would not return anything until the dispute has been opened and investigated.

Right. Packing them up to return now.

I checked the item/listing history and they had been listed continuously since 2010 Shock and the condition is frankly far from 'excellent'. I just know there will be more hassle over this, I can't imagine she really will just refund me when she gets them back.

Just reassure me someone - she is insisting that there is no paint on them or othe damage and that the refund will only be given when they are seen to be in the same condition she sent them out in. Will I still get the money back even if she tries to say I damaged them myself?

OP, it isnt up to her to decide the rules, it is upto Paypal. They are the ones who say you have to send it by a fully trackable method of posting.

Do not send them back, dispute them as Item Sent Not As Described.

I've got a SNAD dispute running but the seller keeps responding with a 'return for refund' option - should I wait then and escalate it as soon as I can? Won't the outcome of any claim just be that I'm told to return for a refund anyway? That's what the seller is telling me wil happen, I know Ebay can refund without goods being returned but from a bit of reading up, it looks like they only do that if the goods were fake.

ok you do need to send them back, and you need to have tracking and proof of delivery.

as long as you have proof of delivery (ie, she has signed for them) then you will be covered.
i'd be tempted to send them via parcelforce, they aren't too expensive, because you can check online whether they've been signed for or not.

once ebay knows she has received them they WILL refund you whether she wants them to or not

sorry, no if the seller doesn't respond then yes, you will get the money back.

but she IS responding, and she is asking you to return them. so ebay will expect you to do that. sorry

Make sure you have plenty of detailed pics of the boots-try to get the same photo she used to sell them as well as pics of the paint damage so you can clearly show they can be photographed to hide the damage.

so long as you send it by a trackable signed for method of postage then, she cant demand how quickly you do it within reason, nor can she demand who you use.. you will get refunded all your original payment, but I doubt you will get back what it has cost you to return them, but you can still leave her a neg

Just be sure that the trackable method you send is acceptable to ebay. She sounds like if there's a way of doing you over again then she will. If I were you I'd go Royal Mail all the way.

I got ripped off by someone who claimed to be selling 3 genuine, used LV handbags for £200. Only 2 arrived and were fake but very good copies. I complained, had to return them and could only get £40 from Paypal since that was all the seller had in her Paypal account. Recently, I bought some Toy Story figures and only noticed they were from China after I paid for them. They never arrived and I got a full refund.

Send back the boots and get a tracking number and hope for the best.

Be careful using a courier, some do not insure second hand items. Also, do not use recorded delivery, as it does not always require a signature & if not signed for the seller can claim they did not receive them.

You will need to send them back to get a refund, however it is worth phoning ebay customer service (not live chat) and ask if they will provide the cost of postage which they will do in certain circumstances.

Money Saving Expert has an ebay forum, it is very useful for situations like this.

New Rocks eh? I'd be surprised if there are any decent second hand ones. It goes with the territory Grin and, yes, I have some myself.
Having said that, the Trades Descriptions Act allows you to claim a refund if they are ' not as described' . Ebay usually refunds in these cases IME.

If the OP sends them back by a trackable method, then it doesn't matter whether there is a signature or not - it just has to an 'attempted' delivery. So if the OP sent them back via special delivery, and the seller refused to sign, it wouldn't matter as the tracking would show 'attempted delivery'.
