to think this Ebay seller is a deranged twat?

Long story short, she sold me some 'excellent condition, hardly any wear' boots for £50.

They arrived and have green paint on both boots, which someone has made a half arsed job of removing. They were photographed for the listing in a way that meant you couldn't see the affected side of each boot Angry Its still really noticeable (pic on profile) and there is also damage to the lining of one. I opened a dispute as she refused to discuss it privately Hmm Returning them will cost £24.50 by Special Delivery (which is the service she asked me to use) so I told her I'd send them back by Collect+.

She has replied all shoutily with loads of capitals, telling me that Collect+ is not an acceptable service, she won't refund unless I send it by a service she considers acceptable, there was no paint but even if there was it should be expected on used items, and that I had no right to open a dispute and cause "all this aggreviation", oh and that she doesn't appreciate me accusing her of lying.

I just now she is not going to refund me whatever I do and am RAGING as they were bought with some birthday money and were a rare treat.

Has anyone seen the price of New Rocks? £50 is an excellent price. But not for anything covered in green paint. Also, it's perfectly possible to have second-hand New Rocks in saleable condition - I appear to be collecting the full range here!!

But I fear you will have to return these, OP, in order to get any sort of resolution.

They aren't actually New Rocks - they are a similar looking thing from a company that make vegan shoes [hippy]

Anyway. Seller is now saying I must have purposedly damaged them and have failed in my duty of care to the item Shock

For FUCKSAKE.

Now she has told me she will be taking me to court as I have damaged the boots and she has proof that they were not damaged when she sent them to me. Her 'proof' is the listing photo which tbh looks like it was taken with a c.2000 digital camera, its pretty grainy and dim. Plus, as they had been continually relisted since 2010 (I checked the item history) a crap photo from 2010 is hardly any proof of the condition they were sent out in two years later!!

Er - she can't really take me to court can she? [worried]

I would be tempted to send all her mad correspondence to eBay and ask them to intercede.

Yup, you need to copy Ebay in on all of this. I would also seek their advice as to whether, given these recent developments, you should return the item.

There's something you can do, I used it when my account was hijacked, where you can live chat with someone from eBay.
From the start of the thread, I've been thinking: when you send them back she will say they aren't in the condition she sent them in!
You need to keep eBay up to speed on everything.

Are they Madfish? If so, they've gone bust I believe - I'd be tempted to try to clean them & re-list them after a decent interval, as you can't get them anymore Smile.

Meanwhile, yep, go via dispute process, since seller is clearly BU...

Don't rely on ebay poen a dispute through paypal if you paid that way. I sold a karen millen top to a lady on ebay who paid with paypal, she asked to pay extra to have it guaranteed next day so she could wear it to a wedding - then a few days later she comlained it was stained and damaged. (It wasn't when I send it) but as she opened the dispute via paypal they ALWAYS take the buyers side and they refunded the money to her. I did recieve the top back eventually ripped, stained with red wine, stinking of fags and booze - clearly she had worn it to the wedding and then decided to send it back. So I ended up paying for her outfit plus the cost of posting it to her.

Point is they will side with you and you will get refunded.

On another note, I have the exact same boots. Very comfy they are [not helpful]

Op it's worth a call to complain about her abusive messages, infact you can copy and paste into your dispute.

Mum had a lot of this stuff when she used to sell on ebay. Never knew there could be so many idiots out there. So many used to say they never received parcels to try and get a refund, which they seem to try a lot looking at their history. Or some saying "it doesn't fit me properly" saying mum misled buyer?? So she got ebay involved and they sorted it out properly. Showed mum this thread and she said "don't get involved yourself - let ebay do it". Keep all correspondance.

I've only ever once filed an Ebay dispute in five fucking years, and that was seller who didn't send the item out for NINE WEEKS! So I'm hardly going to start damaging stuff just for the lolz now, am I Hmm
