To be livid I have been ripped off

I bought a car for £500 on Thurs, debit card payment kindly paid by my mum who I will repay via instalments.

Saw pictures of car and asked obvious questions, taxed, length of MOT, no tax, fair enough, can sort that still a bargain, MOT'd til Sept, little short, but ok.

Guys deliver it - small car rental company btw, not private, little disappointed with it, but was just so pleased to have a car. Off they went and I had to go out soon after.

Having had the chance to look through the paperwork I was shocked to see the MOT actualy expires in July, the 13th, so effectively a six week MOT, this guy blantantly lied to me as I would NEVER purchase a car with 6 weeks MOT left on it, I paid the going rate for this model, exact same cars around with much longer MOTS, so not a bargain in that respect.

I am absolutely devastated, and feel so so sad.

And tax?

TapirBackRider · 04/06/2012 01:34

Would I say the same to a RL friend? Yes, have done before, she was far too trusting and naive and bought a complete lemon. All because she didn't check out the stuff she was supposed to.

Which is the same in this situation. When you make an important purchase like this, you check it out, every single time and never trust the seller because they only care about the money. If the OP has any corroboration that they were told this, then there are legal avenues available - otherwise it's their word against the sellers.

Birds Who are you quoting??

Thank you so much to all who came on this thread to offer support and advice, not sure why people feel the need to be so nasty, I've spent most of it in tears, so thanks.

Anyone would think I'd been the one ripping people off, I thought I was dealing with a professional businessman.

op just a word of caution with the MOT.
Welding, it may not look rusty to the eye but an mot inspector goes all over the underside of the car and puts nasty little yellow crosses at all dangerous points which need welding.
Emissions, a car has to pass this test and it can be very expensive if there is a fault.
Tyres, I bet my bottom dollar it will need at least one.

If it is a business ex rental I am sure as others have said that you do have rights. good luck.

I think people are being rude to the OP. Lay off, helpful advice only! It isn't helping though OP that you haven't said whether the advert said September, or how you were otherwise told.
I agree that best thing to do is to push hard for a full MOT to be done now, or you want a refund. You could even offer to pay the £38 MOT fee IF it passes.
It's not unusual to buy an untaxed car, I've bought more expensive ones that are untaxed. They don't want them taxed on forecourt with the tax running out. It's quite common for them to tax it for you after the sale - charging you the full cost of tax separately to vehicle price.

zookeeper · 04/06/2012 10:08

YANBU Op - you were lied to about the MOT. Hindsight is a wonderful thing. I would be asking for my money back and letting them know very clearly that if I didn't have a refund I would be telling everyone what a conman the vendor was.

NormaStanleyFletcher · 04/06/2012 10:20

How was the car advertised - did the advert state length of MOT?

DO you have a copy of the advert?

Was it advertised as being sold by the company or by an individual.

So sorry you have been put in this position, it can be easy to overlook something like checking the MOT certificate.

There is some good advice here, and if you can let us know about the advert, then I am sure the lovely MNers on this thread who have given good advice would help to put together a letter.

Op,have sent you a PM.

starmaker7 · 04/06/2012 13:13

oops pressed enter by mistake ,there is also a ink on that link ^^ about your rights if you paid by credit or debit card ,good luck xx

TapirBackRider · 04/06/2012 14:18

The OP has rights - but may not have any corroboration for the claims that she is making. If any legal claim is made, it will the OP's word against the salesman.

How is telling the OP to never trust a car salesman not helpful and rude??

bobster64 · 10/04/2013 10:40

£500 is a huge amount of money when you havnt got much or £5000 it doesn't matter, the truth is there are many unscrupulous people out there trying to part you with your money, from lying about MOT dates to selling you a car with outstanding finance, insurance write offs that are back on the road and dangerous, to cloned vehicles, it's a nightmare and getting worse, for good advice go here www.vehiclecheckuk.co.uk 1 in 4 cars come back with a discrepancy. Please be thorough before you part with your money, if a car seems to be too good to be true it probably is.

OP, I feel for you. I have only just seen this thread but my heart goes out to you. Ignore the holier than thou comments, they are always from people who unfortunately would never end up in your situation.

And to whoever said what does being a single parent have to do with it? Ermm, everything, when you are not able to afford to get a loan to by a decent car and when you also want to better your life for you and your children. Do you not have a 7-day 'get out clause'. I'm not sure but I'm pretty sure that it states something like that in the sales of goods act or some such.

Good luck and I hope it all works out.
