To be livid I have been ripped off

I bought a car for £500 on Thurs, debit card payment kindly paid by my mum who I will repay via instalments.

Saw pictures of car and asked obvious questions, taxed, length of MOT, no tax, fair enough, can sort that still a bargain, MOT'd til Sept, little short, but ok.

Guys deliver it - small car rental company btw, not private, little disappointed with it, but was just so pleased to have a car. Off they went and I had to go out soon after.

Having had the chance to look through the paperwork I was shocked to see the MOT actualy expires in July, the 13th, so effectively a six week MOT, this guy blantantly lied to me as I would NEVER purchase a car with 6 weeks MOT left on it, I paid the going rate for this model, exact same cars around with much longer MOTS, so not a bargain in that respect.

I am absolutely devastated, and feel so so sad.

No one is kicking you when you are down. I don't suppose they lied on purpose, more likely couldnt be arsed to check for the sake of such a cheap car. Going to the papers and claiming poor single parent on benefits is over the top.
I am sure that next time you buy a car you will check the paperwork before buying it.

1/ Yes they lied.

2/ Your mistakes were to trust them, and then to enable them to get away with the lie by NOT reading the vehicle documents. This is down to you - you are not blameless in this.

I paid the going rate for this model, exact same cars around with much longer MOTS

so why buy this one then in the first place???

I don't think the OP is getting a kicking. But I do think people are reasonable to point out that buying a car without seeing it or checking the paperwork was unwise and will probably jeopardise her claim against the seller.

cant believe you didnt check everything before they left - especially as you hadn't seen car previously.

he probably wanted to sell it a bit cheap as it wont past the next MOT. try and get them to get the MOT done for you. however, if it was going to pass i think he would have already done that and sold it for more with 12 months MOT. how did you buy it - where did they advertise it i mean?

You have been taken in by a company you believed would be in the up and up. Naive maybe, but don't know why people are giving you a hard time!
I would definately not let this go.Hopefully they will get back to you and put it right.
If they ask what you want them to do, tell them they can put a 12 mnth MOT on it and you will let the matter go!

They haven't really ripped you off I'm afraid - if they told you that either the car had just passed and had a full year mot, or that it was moted when it wasnt, that's ripping you off.

I am sympathetic - honest - but the car is still as was really.

rhonda, they certainly have ripped the OP off. They told her the MOT was until September. It wasn't. She should've checked the paperwork, certainly, and I'm sure she will in the future, but she was lied to and subsequently ripped off.

Do you have proof they told this? Or was it a conversation. You have learnt a hard lesson. When buy most things you have to check them out.
imo you are being ridiculous about going to the papers. I work in complaints and whenever some says they are going to the papers it makes me inwardly laugh. It won't make them take you seriously.

Have a word with your bank. If you paid by visa debit you have protection under the consumer credit act and you could get the transaction charged back and return the car. The bank should have a legal team who will advise you if they can do anything to help. If not try trading standards

Your rights if you buy second hand cars from a dealer
When you buy a second hand car from a dealer, you have a right, under the Sale of Goods Act 1979, to expect the car to:

be of satisfactory quality (taking into account its age and mileage)
meet any description given to you when you were buying it, and
be fit for the purpose (for example, to get you from A to B safely)
If the second hand car does not meet these requirements you have a right to claim against the dealer for breach of contract.

If you buy a second hand car privately
If you buy a second hand car from a private seller you have fewer rights than if you buy from a dealer. Key parts of the Sale of Goods Act don?t apply ? there is no legal requirement that a car is of satisfactory quality or fit for its purpose.

However, legally, the seller must:

accurately describe the second hand car (for example, an advert must not say ?one owner?, when the car has had several)
not misrepresent the second hand car (tell you something about the car which isn?t true ? so, for example, if you ask whether the car has ever been in an accident, the owner must answer truthfully)

So in either case the car be accurately described. If you have proof that they described the MOT as "until Sept" then take the car back and ask for your money back.

Dealers must also say they are a dealer in adverts. They cannot claim to trade privately.

Gosh what a load of 'orrible lot you are, poor op she is upset and 500 quid is a lot of money especially when you only have one wage.

Im not sure what world a lot of you live in but my first car was a few hundred quid and my ds's first cars were too.

Of course she should have made better checks with hindsight but I think she knows that now and doesnt need it pointed out any further.

I have just bought another car second hand and today noticed a few things that i hadnt before such as a switch doesnt work and a light cover is wobbly,it happens to all of us op.

Check it out with cab and then move on and hope it goes through the mot.

If you cant afford the £40 mot, how do you plan to tax, insure, maintain it and fuel it? If you have the fact the MOT is until Sept in writing then ask for a small discount.

Not sure what your relationship or unemployed job status has anything to do with checking car paperwork though.

She's presumably worked out how much money she has spare and does not have 40 quid on top of that. Why ask 'if you can't afford 40 quid how will you tax/insure it'? That sounds like a question only someone who has never made a budget could ask.

I would be livid if I were lied to like that - it is a big difference.

It's really unpleasant IMO to be sneering that the dealer probably did not bother to check the dates for such a cheap car. It's the car the OP can afford, obviously. Equally obviously money is tight so she does not have any spare to pay for someone else's lies. There's nothing to be ashamed of in having to budget carefully.

£500 for a car. That is very cheap. I am surprised it would even come with an MOT tbh. You get what you pay for!

I am wary that the dealer said iot was his personal car, sounds like he's trying to claim he is a private trader.... Hmm
