To be livid I have been ripped off

I bought a car for £500 on Thurs, debit card payment kindly paid by my mum who I will repay via instalments.

Saw pictures of car and asked obvious questions, taxed, length of MOT, no tax, fair enough, can sort that still a bargain, MOT'd til Sept, little short, but ok.

Guys deliver it - small car rental company btw, not private, little disappointed with it, but was just so pleased to have a car. Off they went and I had to go out soon after.

Having had the chance to look through the paperwork I was shocked to see the MOT actualy expires in July, the 13th, so effectively a six week MOT, this guy blantantly lied to me as I would NEVER purchase a car with 6 weeks MOT left on it, I paid the going rate for this model, exact same cars around with much longer MOTS, so not a bargain in that respect.

I am absolutely devastated, and feel so so sad.

Really sorry to hear what happened, my first car was £600 and I found out was a cut and shut, so basically worth nothing!!, luckly I managed to get my money back by kicking up a big stink. But I was 17 at the time and didn't know better, I've learnt now to do HPI checks the works.

The MOT money will maybe be more than £40, But what always baffles me is the people online saying they can't afford stuff when broadband costs average £15 a month if not more -I would be putting mobility above being online anyday!

TheHouseOnTheCorner · 03/06/2012 18:08

You are all being disgustngly mean to the OP...she feels shit and vulnerable and all you lot can do is laugh.

OP...I can't advise but I am very sorry. Sad

QuintessentialShadows · 03/06/2012 18:09

£500 is a lot of money to spend on an unseen second hand item. £500 is very cheap for a car.

Birdsgottafly · 03/06/2012 18:11

You have consumer rights when buying a car and even in some circumstances a 'cooling off period'. Ignore the posts that are not upto date on the law.

I would try to do a deal with the garage, if you want to keep the car.

My DP recently got a new clutch fitted by the person he bought his car from, just after buying it, because if it is a business seller, they are bound by the law goods, even used cars as being fit for purpose, or as described.

Birdsgottafly · 03/06/2012 18:14

This is down to you - you are not blameless in this
I really doubt that you'll get far with any complaint

Yes you will, your purchase is covered under the law because you have bought of a business seller and not private.

LRDtheFeministDragon · 03/06/2012 18:16

I would put educating myself a bit about how useful the internet can be when trying to save money above commenting on how someone else spends their money ... but hey ho, we can't all be the same.

500 is a cheap banger, but surely this is why the OP can afford it? So it probably matters to her rather a lot that she shouldn't have to spend more than she agreed to spend.

I don't really see why it's relevant how much the car cost, or how much money the OP has, or whether we think she's being silly to buy broadband as well ... the point is that she has been ripped off, and obviously won't buy a car unseen again (!), but is still in her rights to feel angry.

I'm really surprised more people aren't disgusted at the car seller cheating someone like that - he clearly saw her coming. Sad

mirry2 · 03/06/2012 18:16

Did the advert state the MOT was valid until September?

Birdsgottafly · 03/06/2012 18:20

The OP has entered into a contract of sale based on the information given. the seller gave her incorrect information, so he misrepresented the goods, he is at fault as he has a code of practice/laws, to abide by.

PooPooInMyToes · 03/06/2012 18:24

Cabbagesoup. The MOT money will maybe be more than £40, But what always baffles me is the people online saying they can't afford stuff when broadband costs average £15 a month if not more -I would be putting mobility above being online anyday!

What a load of rubbish! I am skint but still have broadband because it saves me a lot of money, doing my shopping online so i can mealplan better, by always having access to job websites, and by having my email so i can work from home on a freelance basis. That's all worth much more then 15 quid a month Hmm

The benefits of having access to the internet are endless, including online checks you can do on new car purchases. Don't be too judgmental now will you Hmm

MyCarHasBrokenDownAgain · 03/06/2012 18:34

Not much help I know, but Halfords do a half price MOT. Obviously not much help if it doesn't pass tho Sad

PooPooInMyToes · 03/06/2012 18:37

Oh and lets not forget ebay . . . Where i buy a lot of my kids and my clothes, shoes etc that they need and things for my household such as spare parts for my Hoover so that i didn't have to buy a new one and so saving a lot of money.

Plus the option to sell things, last month i made a 60 quid profit from selling things i no longer need.

That's what us poor people have to do. Id rather not be told that Im too poor to be on the internet by well off people who haven't got a clue! Angry

Hit a nerve sorry - who said I was well off?? and you tell me not to be judgemental Hummm.

I do understand the benefits of the internet, but it's not essential, the car clearly was something you wanted and needed so in order to afford MOTs and running costs we have to give something else up I assume??

LRDtheFeministDragon · 03/06/2012 18:49

cabbage, if someone on 40k had been cheated, would you also be telling them 'hmm, we have to give something else up, I assume'?

If you got cheated, do you automatically think 'ah well, it must be my own fault for being so stupid as to expect to get what I paid for ... better cancel the internet subscription'?

If not ... why do it here? Confused

PooPooInMyToes · 03/06/2012 18:53

Cabbage. You must be well off if you don't understand the financial benefits of being on the internet when you are skint.

Why oh why is a thread where a person has been conned out of what is a lot of money to them, met with reactions of "well you shouldn't be on the internet anyway as you can't afford it"!?

cabbagesoup · 03/06/2012 18:57

You know what LRD yes - I got cheated before as mentioned I do feel for the OP I felt stupid and angry myself but that's life you live and learn and move on, and I'm sure the car will be fine etc.

She is also talking about not being able to afford the MOT and other posters have mentioned the cost, other people mentioned the running costs etc, Im not saying I don't feel for her I do of course, but I was suggesting that if your wanting to keep the car then the money spent elsewhere would need to go towards the car / MOT /etc

I really don't mind who's on 40K, 20K or 10K to be honest it makes no odds to the OP's situation.

I have in the past cancelled my internet for 6 months to pay for food and bills, so I know what it's like to give up.

Maybe the OP could afford the MOT in September because she could save for it whereas six weeks notice may be a struggle.
As for Internet access, no matter how skint we are we will always budget for broadband as it is essential to us to save more money than it costs and also for our DC's education.

FallenCaryatid · 03/06/2012 19:27

Last MOT I put my car in for, it needed a new cam belt and 2 tyres, Cost me more than £500 to get it through.
OP, good luck with your complaint but I really hope you have factored in insurance and the sheer cost of running a car over a year.

PooPooInMyToes · 03/06/2012 19:31

My mots usually cost a couple hundred as well.

lifesalongsong · 03/06/2012 19:36

Those of you who are laying into the OP, would you say the same to a RL friend who had the same thing happen to her?

Everyone makes mistakes, this is could be a costly one and I'm sure the OP won't make it again but she's entitled to be pissed off about it.

Good luck with getting something sorted.

lifesalongsong · 03/06/2012 19:37

PooPoo - does that cost include work being done? If there isn't anything wrong you shouldn't be paying more than £40 for an MOTtest.

PooPooInMyToes · 03/06/2012 19:45

Life. Oh god yes! There is always something isn't there.

AdventuresWithVoles · 03/06/2012 20:07

Live and learn

FashionEaster · 03/06/2012 20:15

My MOT cost £38 last week. Obviously if your car fails its MOT that's going to be costly and am guessing that it will need work done on it, given it's ex-rental and they misled you to offload it. So actually yes, go back to them and be formidable. Use the links others have kindly given you though so you are armed with what to say. Good luck
