To shop neighbour who has been given disability car as a "gift"

Jollyranchermuncher · 22/10/2011 13:20

neighbours dad has a brand new sporty disability car that he has gifted to his daughter for her own full use.

It is hers, the dad stays in the next town and never it, I know she has full use of it.

Usually I would mind my own business over most things but it just makes me seethe that she has been given this and so many people who need things have to go without.

It also has a built in bluebadge so she can conveniently park in disabled spaces.

Am not quite sure how payment for disability cars work I take it her dad has to use his dla for the car? But it still seems like a huge take the piss off the system?

The insurance works that you have a named driver, in the OP's case this woman who drives the car would be the named driver on the policy thus insured.

rhondajean · 22/10/2011 16:15

Being dim here - whats the difference between buying and leasing? Surely if you buy you are just as well buying any car?

FabbyChic · 22/10/2011 16:15

Its lease only I believe as you only get it as long as you get Higher Rate mobility, if that stops after three years because that is how long DLA is awarded for the car has to go back.

borderslass · 22/10/2011 16:15

Leasing covers servicing etc.

FabbyChic · 22/10/2011 16:16

When you lease the insurance is paid for as is the car tax and repairs. When you buy you are responsible for repairs, car insurance and road tax.

timidviper · 22/10/2011 16:16

Fabby Surely even if she gives her relative the money it is wrong if the scheme is in any way subsidised by the taxpayer.

Thanks Fabby and Borders - so how does buying differ from choosing to buy a car on the "open market" and pay for it using your DLA payments? (told you I was being dim)

TheMonster · 22/10/2011 16:18

dob her in. nothing will happen but you'll feel better.

thefirstMrsDeVeerie · 22/10/2011 16:19

Debs the trouble is that people have perceptions about what benefits a disabled person.

For example as I am women and a wife, there are plenty of people who would see me doing the shopping as my job, taking the kids out, my job etc etc.

If I were the disabled one and my husband the carer I think things may be different.

'isnt he wonderful taking those kids out, isnt it a shame he has to do the shopping every week - his wife is disabled you know'

I also feel strongly that people with disabilities have a right to as normal a family life as possible. That is the point of things like DLA and mobility.

A family shouldnt have to run two cars just because one of the parents is disabled. If they need mobility to provide them with a car then surely it ridiculous for them to have to get another to avoid percieved misuse of the mobility one?

It comes down to the increasing belief that the public have a right to tell disabled people and others on benefits how to spend their money and time.

BUT if someone thinks there is genuine fraud they should report it. Not moan about it. Do something about it.

FabbyChic · 22/10/2011 16:20

When you get a mobility car you get from a car dealership and the car will be brand new.

I work for a Car Dealership and we have lots of motability purchasers, we get the money up front for the vehicle in full, motability deduct from the person who gets the car.

It has to be by hire purchase because Motability pay a specific proportion if you dont get it anymore they cease to pay it.

madhairday · 22/10/2011 16:26

That's why we haven't gone for a motability car MrsDV, because then we would have to run two cars which would be a/unnaffordable and b/pointless in that I don't get out a lot and don't go to work for eg. Dh wouldn't be able to use the motability car for his usual work and errands that weren't for me so all in all although it seemed a great idea at first and we thought it would really help it ended up being something that would make things more difficult.

What is this disabled tax disc though, I've not come across this and actually hadn't realised those on HRM got tax disc paid?

OP I would usually come down v much on the side of the person with the car because I know what it is like to be judged unfairly, but in this case it sounds dodgy particularly with the blue badge use. Still, don't assume she is never using it for him.

Thank you voidka but I've actually been around for years.

Ah thanks that makes a bit more sense now.

Mrs DV I am feeling for you, there are people who take the mick out there but in my experience they are few and far between but they do end up getting all the press and making people suspicious. It would be fab sometimes to see stories in the press about people who are entitled to the benefits and the difference they have made in their lives wouldnt it?

mad hair this is the link about the tax disc but its very restrictive, we spoke to them and the car must not ever be used for anything except the disabled person:

FanjoForTheMuahahammaries · 22/10/2011 16:57

You don't get a brand new sporty car with motability, your benefit covers basic one and you fb.pay extra

madhairday · 22/10/2011 16:59

Thanks herbietea and rhonda, I see we wouldn't be entitled as you say because it has to be for sole use of the disabled person, which is the reason also we didn't get the motability car. I think it's fair enough really but it can be hard when it would make a difference to have a motability car.

r3dh3d · 22/10/2011 17:10

Well, imo the car is one thing and the badge is quite another. I don't agree with him giving the car away, but as others have said, it's not free, it's either bought outright or being paid for out of your mobility allowance. Maybe he got it then found he was unable to drive it because his condition worsened - I can see the temptation not to "waste" all the money he has paid by leaving it on the drive, though I couldn't do it myself.

Her using his blue badge is abysmal. I would have to shop her based on that, tbh, I'm not sure what there is to discuss about it? She's parking in spaces that people with genuine disabilities desparately need, and perpetuating this horrible myth that badges are given out like sweets to people who don't need them, and thus it's OK to park in a disabled bay "for five minutes" because they're all a load of fakers, aren't they? The problem isn't how they are given out (can't be foolproof but it's pretty stringent tbh) but that they get stolen, or held on to when no longer needed, or given away like this. And more people who do this need to get caught, for the sake of genuine badge holders. Shop her, please.

shop them!

and no such thing as a built in blue badge the car will be reg as for a disabled persons use and will be tax free, the tax will state DISABLED on the paper disk, as the car is reg as for a disabled persons use the car will not pay and congestion charges ect

a motabilty car can be used by someone eles if its for the disabled persons benefit, ie, doing shopping or paying bills for them,

the rules are very strict

FanjoForTheMuahahammaries · 22/10/2011 18:27

Oh sorry, I didn't know, we are eligible for the scheme but don't use it.

onagar · 22/10/2011 18:31

Jollyranchermuncher you say It also has a built in bluebadge so she can conveniently park in disabled spaces.

but do you know if she has used it for that or was that a guess?

borderslass · 22/10/2011 18:33

Fanjo you should be able to get a blue badge for your DD though.
