Help! DD getting sued for £1Million for rubbish hair do!

Eldest DD has just phoned from her bf's house in floods of tears. She recently qualified as a hairdresser and had just started her first job as a 'self employed hairstylist' last Monday. She should have received her first wages today. She won't be receiving anything this week. She has done a perm today on a lady who insisted on having it done despite DD advising her that her hair was not in good enough condition and the end result would not be good. DD should not have gone ahead but she did and the result was worse than she had expected. The lady's hair broke and had to be cut an inch short. The lady is going to sue DD. I have tried to reassure devastated DD over the phone. What should she do now?

At this stage, she's only threatened to sue. She's probably very angry and upset right now; she might well realise that she's overreacting and not take it any further. Or she might just be talking big in the hope of getting some compensation.

Your poor DD, on her first day. Did anyone else hear her advising the customer not to have a perm?

Has the woman heard of the saying "You can't get blood out of a stone"?

Any solicitor worth his salt will tell you that there is no sense in issuing a writ for £1 million upon someone who hasn't got it.

i have no idea what she should do, but i am pretty sure they can't not pay her!

she also won't be sued for £1million either Hmm in fact, i'd wager she wouldn't be able to sue her at all.... esp as she was warned it would not be good

why did dd go ahead and do it though??

just re-reading sorry... does she work as a self-employed stylist for a company? or is she just working for herself?

so because of a 'do' she did today, she wasn't paid, today? but she is self employed? who does her wages then?

And it can;t be the first time a customer's been unhappy with a haircut there; does the salon have a policy for that sort of thing?

Someone might say that but they won't get very far. It'll be a knee-jerk reaction.
Any witnesses to her warning her it wasn't a good idea?
If she works for a salon then they should have insurance.
Also courts would only award on actual damage done - it's not like she's lost a leg or anything. It might be a bit humiliating but unless the lady was a hair model shes unlikely to get very far.

Did anyone else hear her tell the woman not to get the perm done?

She will hopefully get off with this as she hasn't done anything wrong and will know to refuse to do something on someones hair that isn't suitable!

She was given the figure of up to one million by her boss. I have tried to help her get this in perspective. If she were a doctor or nurse and made a wrong judgement, someone could be injured or killed. No one gets sued for a million for a hair do. I do hope she had insurance. Would the salon be liable or DD?

as you are talking 'wages' she must be working from a salon. the salon will have their own insurance, or they will have made sure dd has her own before she started as a 'self employed' stylist from their premises.

so, insurance will cough up. this will have been covered in her training. it ain't a great start, but maybe will teach dd to stick to her guns.

if she did warn the customer and customer insisted, then it's all bluff and nonsense anyway. but dd's reputation will suffer.

i don't get why she's not getting any 'wages' though. unless she gets a set percentage of each client done, and she was her only customer, and refused to pay...

she should be more worried about the salon tbh.

can you clarify her working conditions? she must have known if working there as 'self-employed' meant she needed her own liability insurance.

I had to sign a paper saying I acknowledged getting a perm and highlights the same day was against their advice. Your dd should do that in future to protect herself.
A million is ridiculous amount. The woman is off her rocker. I don't think any judge would ever entertain agreeing ti such an crazy amount for having to get hair cut short. I would hazard a guess maybe enough for a wig or extensions, with a bit for pain and suffering. If that.

I think the salon should sitll have Professional Indemnity Insurance or should have checked that your daughter does. I doubt the woman will get far far with her threat to sue. Does your daughter have witnesses to the fact she advised the woman NOT to have the perm? It sounds like your DDs boss is a bit of a fool as well as this woman. Try to re-assure your daughter.
