AIBU to think the selling something in the style of in not fraud?

Many articles on this one this week. An lady buys a hangbag from a charity shop and puts it in the style of a Radley bag. She's now being sued by Radley for selling it on eBay.
She put it was only in the "style" of Radley not that it was a Radley bag.

I think as long as it is not meant to be an exact fake copy then it should be fine to put in the style of. I've seen that a few times with e.g. A warehouse dress in the style of Vivienne Westwood.

I think she was just chancing her arm and should have just put it in as a bag with the basic description. Name dropping is naughty.

These really piss me off on eBay so serves her right. If I want to search for 'BNIB Converse' I don't want some shit copy from Next coming up. Was it a copy of a radley bag or just a bag?

I agree with the points here and eBay is awashed with fakes. I know this to my own experience. But if someone is selling something to say it genuine and authentic when it's clearly a fake a can understand someone being sued but in the style of to be is so different

I got an item removed for saying it was a chanel style necklace. Very annoying because I made it very clear in the auction that it was a vintage copy of a chanel piece.. which it bloody was!!!

I think it was the naming of the brand in the advert that is wrong. She was clearly trying to generate more interest in the advert by using the word Radley. It plants the idea in someone's head. She should have just called it "handbag with dog motif" or similar.

Nothing new about the term 'keyword spamming' - worra is absolutely right. For better or worse Ebay is not what it once was and you just can't do this shit anymore and it's not even worth trying.

I've not shopped on eBay since buying what I thought was a genuine mulberry bag which turned out to be a fake Chinese one.

IF she has stated quite clearly that this is a "similar to, but not" then i can't see where the problem is.

They should not be allowed to put a brand name in the title unless they are the brand name. If they must then they should be made to call it radleyish, or converseish. That way people looking for cheap copies can search those -ish words but people wanting genuine products don't worry about misleading items coming up.

It may well be against ebay's rules, but I don't see how she can be sued for mentioning their name when it was clear she wasn't saying that it was made by them.

Pumpernickel - how much did you pay for your 'Mulberry' bag and honestly - really now - did you think it would be genuine off Ebay?

for years you are not allowed to say in th style of or not authentic or whatever on ebay. Its nothing new.

Africa I paid £190 for a Joel bag that was used. Very silly of me I know but seller had great feedback and I trusted my not so good instints :(
