I have just been accused of fraud!

Right, first post on AIBU

On Tuesday I went shopping for clothes for two events I've got coming up, I had my 5 month old DD with me in a carrier so wasn't able to try anything on so I bought a few things and tried them on at home.

One of the items was a dress, I'm a bridesmaid at my friend's wedding in July, it is very informal and she has asked us to wear floral maxi dresses. I was happy with the dress when I tried it on and sent her a link to it and she likes it too, so great - all sorted.

Yesterday I wrote an email to the other bridesmaid and sent a link to the dress again and noticed it had been reduced from £39.50 to £25.00. So I thought as I had lots of stuff to take back I'd return the dress too and then get it at the sale price.

I went into the shop and explained to the assistant that i wanted to return some items and about the dress and she said fine about the returns but not about returning the dress and rebuying it as this was fraud! Shock

I really don't see how this transaction could be considered fraudulent in anyway - yes I can see how it is a bit cheeky and annoying for the shop but not that I was asking to do anything illegal.

So I said fine I'll return the dress then I got my DH to come over and asked him to go and get another dress off the rack and buy it. The sales assisatnt was not happy at all and said she would have to get another member of staff to serve him. Then followed lots of tutting and 'we really shouldn't be doing this...' etc.

We were made to feel like we were committing a crime,

So..... AIBU or was she?

I used to work in Ladies clothes shops as a saturday girl many years ago, the shops I worked at had a policy of offering the difference back if the item bought went on sale within thirty days of purchase, but only offered this to customers holding the store card, and who had made their purchases on the store card.

I dont think it was rude of you at all, you were nice about it and upfront.

I once had a woman walk in during a sale and complain voiciferously about the cut of a jacket, I really couldnt do anything about the way the jacket was tailored as I was not the one who designed it, she promptly demanded the jacket back after checking the sales floor and realising she had returned the only one in her size. That was cheeky as she had wanted to have it at sale price and had been incredibly rude to me about a perfectly good jacket!

Right, let's sort this out. If you refund an item, the shop needs to have it on the salesfloor for 24 hours before it can be sold to that same person again. I have no idea why as I am too sleep deprived to bother writing it out in full, but reading through the Buppy and LOTM arguements, I felt I had to respond.

Once my brain starts working again, i'll have look up why, but as someone stated above, it is not in your statutory rights to buy it at the reduced price and the item was not damaged or faulty, therefore you were lucky to get the refund in the first place.

It is pronounced mo-hee-to. My friend and I pronounce it mo-jee-to after we overheard an anonymous starlet Lily Allen order one, pronouncing it JUST like that, in The Social.

I bought a trampoline from Argos a few weeks ago for £180 - before it was delivered I picked up the paper and saw it was reduced to £100. We rung up Argos who told us we could cancel the order, and reorder, or they'd give us a cheque for the difference. They didn't seem to see it as fraud.

OP - you're not a fraud, just too honest.

I would. But I am trying to finish a bastarding article on multi culturalism...all the while defending the fact that I don't have a penis, don't drink, don't shop in erm weird shops and I do indeed know what an orangery is (other thread).

This has been said before, but you weren't being fraudulent because you were totally honest about what you wanted to do! In your position I probably would have done nothing, because I am lazy, but if I was going to return the dress in hopes of getting it cheaper, I would probably have pretended it didn't fit or something so you are much more moral than I.

I returned a dress to John Lewis this week that I'd bought from them online. I had the printout showing that I'd bought it when they had a 20% off day, so that's how much I got back. They were so laid back about the whole thing that I swear I could have gone to them without a receipt and got the full label price (it was now for sale at full price again).

Now that would be fraud. I'd have no dress but £20 of theirs.
