If i dont want to sell my home but my ex does how long will the legal process take before im evicted ?

You say that the house is going to be mortgage free in a year. I would imagine that can only mean that you have significant equity. I would sell now- interest rates can only go one way, and when they start creeping up, it'll possibly kill the housing market stone dead or at least negatively impact affordability, and you'll have to take a discount against what you'd get now.

Would you not prefer to take your 50%, buy something else just for you (I assume your children don't live with you) and get it over with?

In particular, whilst I agree you'd need a lawyer, I would advise against delaying tactics as these can get very expensive as they rely on your solicitor pulling every technicality in the book one by one. All these take time, at £18 for 6 minutes (as someone mentioned earlier)

Dyedye has not said how old is, but as a general rule, age can have a significant impact on how much she can borrow by way of a mortgage. A 50/50 split doesn't guarantee that she can buy a house on her own.

There are too many factors to be considered when splitting assets, it is hardly ever as simple as sell the house, divide equity by two. Many people, men and women, agree to unfair 50/50 clean breaks unfortunately. Yes, a legal battle can be a very expensive affair so it is always worth it to check whether what you may get out of it is as valuable as what you will be paying for it, both financially and emotionally.

Sometimes is better to let go of material things to get out in one piece, sometimes you have to fight for those things because you have no option.
