ok so yesterday i had the most embarassing day of my life ever. Rushing through primark to get to boots to get some nappies for dd.dd and ds in the double buggy.

i get half way through the doors out of primark and am aproached by a security guard. to my embarassment ds, age 2,had grabbed a pair of mens boxers Blush and i hadnt realised.

i explained to the security man that i had no idea he had them and offered to pay for any damages caused. he then went on to say he would have to call the police as shoplifting is an offence Blush.

i still cant quite beleive it. i was arrested for shop lifting :(

AIBU in thinking this is over the top? if they had had checked the cctv they would have seen that i had no idea ds had the pants!

If you were going to actually shop lift why on earth would you pinch a pair of boxer shorts from Primark of all places?!
They should have checked the cameras before the police were even called. I am aware many people use the buggy excuse when shop lifting but tell me of one innocent mother who this hasn't happened to? Just last week my 4 year old told me she had popped some Christmas cards in my handbag just as we were about to walk out of Next!

Legally, "theft" is:

DISHONEST/ misappropriation of property/ belonging to another/ WITH THE INTENTION of permanently depriving the other thereof

The CPS would be pretty stupid to try to prove the bits in the capital letters BEYOND ALL REASONABLE DOUBT.

If you get in front of a chippy magistrate however, you may have problems.....

I am a reporter & a case was thrown out of court last week even thought CCTV evidence showed the lady didn't pay for the goods... but the judge said he had to prove beyond reasonable doubt & he couldn't do that.... so she walked!

Even though the CCTV footage from a big local supermarket clearly showed her putting the item in a coloured bag & 'hiding' it under her other shopping bag... she said she 'forgot' to pay for it & just remembered when the security guard stopped her walking out of the store!

She wasn't taken to the station, just give statements @ the store!

Exactly, fairhaired, no way will this ever result in a conviction. The police know it and the security guard knows it.

They are just throwing their weight around to scare customers.

Personally, I will not set foot in Primark again after hearing about this. Crap shop anyway.

It should have been clear that it wasn't you intention to steal, after you'd spoken to him. However, I don't think their overall policy to come down hard on things like this is unreasonable. I work part time in a large store, and have come to know that it is common for people to train even very young children to help them steal. I know that's not what you were doing at all, but that's why they have to treat every case as a crime, since most of them probably are.

DD has done this a few times. A pack of green beans from Tesco, a 5 pack of socks from Marksies, some leggings from h&m and a bar of chocolate from whsmiths being the most recent. I also gave DS a rattle to play with in Tesco one time and forgot about it and walked out. I took it back to the security guard and they were fine about it - even though the tag was a bit soggy and chewed! Usually I'm too embarassed to say anything though and I just go back in and put it back on the shelf and hope they don't notice.
This does seem overzealous OP. Of course SOME parents use their kids to shoplift but a quick look at the CCTV would have saved a lot of hassle.
