We have a shorthold tenancy agreement, and are on HB. Our contract ends in the next few months, and we've been told that our contract will not be renewed as the landlord is selling our entire block.

Apparently if we leave when our contract ends then we are making ourselves voluntarily homeless. And the only way we could be considered actually homeless is if we refuse to leave and have to be taken to court.

This is insane, all it's doing is putting off the inevitable - and putting both us, the landlord and the letting agents through a shit ton of grief first.

Yup. It's how it is, though. :(

ValentinCrimble · 12/10/2010 23:58

No you need to get a letter from your landlord stating his or her intention to move you out...to make you homless. Go to the SHELTER website...there is great legal advice there.

MaimAndKilloki · 13/10/2010 00:06

Thank you Valentin, unfortunately CAB were convinced that the letter wouldn't be enough.

I'd be inclined to go to Shelter too. Very specialist info, and will probably know any provisions for those in your exact circumstances.

Tortington · 13/10/2010 00:12

yes my bil was in similar situation. the council told him point blank that he must wait until he was made homeless

MaimAndKilloki · 13/10/2010 00:27

We will give Shelter a call tomorrow, thank you.

Custardo That's awful :( I'm so scared right now

I a pretty sure you will be heavily protected by law and that they won't be able to remove you until yu have found another place/saved up the deposit...the law is with you as a tenant.

OldLadyKnowsNothing · 13/10/2010 01:11

Can you get another private let?

MaimAndKilloki · 13/10/2010 01:15

Really struggling to find anywhere that

a) takes HB
b) is in our budget

NordicPrincess · 13/10/2010 14:35

theyl put you in a hostel. can you not move to a cheaper area? or tenancy deposit guarantee scheme via council?

HeftyNorks · 13/10/2010 14:39

It's a shit system but sadly how it is. I usually tell families to stay put (am a HV) until they have sought the relevant advice such as Shelter and CAB. It is a truly crap system and so so wrong for everybody. It is - as you say - putting off the inevitable.

MaimAndKilloki · 13/10/2010 21:53

NP We are both disabled (physical and mental health problems) and receiving treatment here, if we move then we have to go back on a waiting list. Plus our family are here, and are the only support we actually have.

are you on the council waiting list? seems obvious but i think you should put in an application now if you haven't already done so
