But no he stays in bed until 9:00, gets up, goes to the fridge and says that there is no milk and then goes back to bed for a further 30 minutes. Then gets up saying that he will take care of her now, after everything has been done anyway!!! Not even a "how are you feeling?" or anything, even though I am feeling really crap with no voice!!!!!!!

YANBU, just take your DD into the bedroom, put her on the bed and tell him to deal with it and then go and run a bath or something so you are out of the way and he has to deal with it.
