to sue hotel chain

We were at a well known hotel this afternoon for Sunday lunch, after lunch we were walking through the reception area where DC (13months old) fell and split open their head on the corner of the table (adult shin height) we had to ask the receptionist for medical assistance, all the while DC screaming and blood pouring everywhere.

We had to take DC to A&E where he needed a GA, however because of past expeirence with this, it was then decided that our baby would go through the treatment and the horrid trauma with no pain relief, he needed 1 inner stitch and 2 outer stitches, and next week he will have to endure it all again.

I phoned the hotel to let them know the result, and asked for safety guards on the tables to stop further accidents like this in future, they said the would get back to me, due to the "design" of the lounge Hmm

Everybody has said to sue, as its the only way they know, that this hotel will take action.

I know this from expeirence sadly also with the chain.

However I feel uneasy about it.

To be fair, by the age of 15 or 16 months, DS1 had had 4 GA's

He'd had at least 22 by the age of 11......

Shiny - I think most of us can guarantee we wouldn't be spending the afternoon on mumsnet expressing our plans to sue though! I certainly can.

I asked that botty and OP admits that she thinks they should have. Her friend is going to help her out now by giving her access to the accident forms from the previous accidents involving said table.

Please please OP don't do anything that could risk you being the wrong side of the law - that won't help your ds.

Thankyou, all Im wanting is to prevent this from happening or safe guards in place, I would even buy them myself.

Mumbar - my thoughts exactly.

I've had situations with my kids (and myself) where there have been accidents and I haven't sued.

DS1 broke his hand really really badly using a defective piece of fitness equipment at school. Which the school knew was defective.

I didn't sue, but the equipment isn't there anymore - there's more than one way to skin a cat

Ah I see. You sound like you have had more reason to worry than was initially clear. If your little boy has a condition and has had multiple admissions, I am not surprised you are freaked out by today's injury.

It will be the last thing you need. But I really think you are trying to find someone to blame for today, and sometimes there just isn't someone.

To be fair, the thread is entitled "Am I being unreasonable to sue hotel chain?' and the answer to that is a resounding YES

No-one is questioning your need to want to protect other DC's from going through this.

My DS has cracked his head open twice in the same place on the same piece of equipment in a theme park - very distessing for me and him. I think to myself what an idiot letting him go again and then well theres probably 100's of kids in there a day and my DS has less chance of winning the lottery the clot Wink

I spoke to H&S and they sent me the actual discription of how this piece of equipment was safety checked and how it had passed. Matbe they thought I might sue Hmm

I think your letting your heart rule your head but if your DS has had 12 GA in 13 months I guess he's already been through a lot?

Its not just babies getting hurt tho, its adults getting deep cuts on their shins, due to the metal.

My child was supervised, he was on reins, however he tripped on the chair, and head went into the corner of the table, yes it was a accident, however we can prevent further horrific accidents like this happening again, with a simple plastic cover.

ok, so you don't want to sue, then why the hell post asking about sueing? and why are you getting accident reports from a friend that will be useless in court and could cause alot of trouble for your friend's future employability?? seems a lot of trouble to go to if you really aren't going to sue.

but............ how did OP manage to have sunday lunch out so quickly(and get seen at A&E) 45 MINS FOR A LUNCH.........(oops) seems more like maccy d's than a hotel

Why wasn't someone carrying the baby then or holding its hand? I'm sorry to say that is how you prevent such an accident happening....

Because it was my friends who suggested suing, it never occurred to me to do so, as I know it was a accident, however further accidents can be prevented.

Ive said from the beginning that I was uneasy with this route, and that I dont want to sue!

I did ask about the speed of the lunch further up the thread.

I think you're placing too much faith in plastic tbh. When children hit their head on things they dent their heads and there is blood. A cover will make it less serious but only if well fitted and maintained. Excluding children from the area would totally eliminate the risk - that's really a preferable option.

And one last thing, in the OP you say you know the only way the chain will do anything is if you sue, due to past experience with the chain.

Is this your personal experience?

Because if it isn't then its only hearsay.

Not admissable in evidence in court.
