to sue hotel chain

We were at a well known hotel this afternoon for Sunday lunch, after lunch we were walking through the reception area where DC (13months old) fell and split open their head on the corner of the table (adult shin height) we had to ask the receptionist for medical assistance, all the while DC screaming and blood pouring everywhere.

We had to take DC to A&E where he needed a GA, however because of past expeirence with this, it was then decided that our baby would go through the treatment and the horrid trauma with no pain relief, he needed 1 inner stitch and 2 outer stitches, and next week he will have to endure it all again.

I phoned the hotel to let them know the result, and asked for safety guards on the tables to stop further accidents like this in future, they said the would get back to me, due to the "design" of the lounge Hmm

Everybody has said to sue, as its the only way they know, that this hotel will take action.

I know this from expeirence sadly also with the chain.

However I feel uneasy about it.

where have I not gave my ds tlc?, he was asleep next to me, while he napped, he has been cuddled into all day, and even now, I am in a makeshift bed next to his cot, so please tell me where I have not been given him tlc.

or do we, like going down this unjustified and fabricated route?

shineon, plenty of our dcs have had accidents and not sued anyone. it is normal. kids fall and parents don't sue anyone.

actually it has - yes I felt guilty but as his parent its my job to access the risks of taking him somewhere and ensuring I keep him safe.

He can also have the numbing cream, as well as the spray.

I am an expert on small boys and stitches (and I have never sued)

You need to take this on the chin and come to terms with the fact that it was just an ACCIDENT and they happen.

FWIW I'm sorry he was hurt, but if that's the worst that ever happens to him you'll have gotten off lightly

I haven't read the thread yet (just settling down to now!) so this has probably been done but if a GA isn't suitable then is there really no other pain relief option? Stitches without anything is madness surely?

yes, they should have told me, however they didn't, I cant help that can I, and it doesn't help the situation in hand, unless you want me to ignore, and then feel horrid if someone else gets hurt and I sat back and done nothing Hmm

I'm afraid you have virtually no grounds for a claim against them.

I am so sorry for what happened to your baby but at that age, someone ought to have carried them. It would be ridiculous to expect hotels to baby proof every stick of furniture in the establishment on the off chance that a child may fall. A 13 month baby is not completely steady on their feet and should have been carried. The hotel are within their rights to argue inadequate paretnal supervision: either carry the child or hold his/her hand.

The sad thing is there will be some ambulance chasing law firm that will take this non-claim. I ought to know :)

no not at all, but as a parent and have many have stated it does seem odd to be posting on here when child has had an accident so soon after the event.

Sorry if I've got it wrong Blush but it obviously how it came across as many said the same.

Rockbird, yes its madness, and yes it was horrific, (as dh told me, as I couldn't go in) but the choices we're what we we're given, they said it would have been more stressful to inject the anesthetic, and then pin him down again, they done it this way to ease stress, and pain was a manner of Min's.

hes none the wiser and now.

I know this was a ACCIDENT! I know this. I just want to prevent it from happening again, as going by the staff it will.

I do believe if you have a case or an accident is preventable then something needs to be done.

BUT you asked if you ABU. The general consensus is yes you are but hope DS is ok. That should tell you something instead you come up with a great list of accident reports talked about - that is breach of confidentiality and illegal btw, that your friends knew this was dangerous place but neglected to tell you and a staff member had multiple pins in her leg from working there.

Using your stealth tactics is making it worse I'm afraid Sad

It's a table. They are commonly found all over the world and unless very much provoked they don't tend to rise up and bite innocent passers by. People will get hurt if they fall over it - accidentally and a fairly rare event. The chances of someone sustaining a head injury like your ds are really very small unless they are also very short and wobbly on their feet.....

Weren't you allowed to go in to be with your DC for their procedure? That's more worrying than the accident itself. What happened?

Maybe mumbar, I just dont want this happening to another baby, that isn't bad now is it?

I dont care about money, I dont want to sue, even if I could, I just dont want another baby to go through this.

My son has had 12 GA in total, due to his condition. not relevant, but also relevant in how they didn't want him to undergo another one, due to his past 3 reactions.
