to sue hotel chain

We were at a well known hotel this afternoon for Sunday lunch, after lunch we were walking through the reception area where DC (13months old) fell and split open their head on the corner of the table (adult shin height) we had to ask the receptionist for medical assistance, all the while DC screaming and blood pouring everywhere.

We had to take DC to A&E where he needed a GA, however because of past expeirence with this, it was then decided that our baby would go through the treatment and the horrid trauma with no pain relief, he needed 1 inner stitch and 2 outer stitches, and next week he will have to endure it all again.

I phoned the hotel to let them know the result, and asked for safety guards on the tables to stop further accidents like this in future, they said the would get back to me, due to the "design" of the lounge Hmm

Everybody has said to sue, as its the only way they know, that this hotel will take action.

I know this from expeirence sadly also with the chain.

However I feel uneasy about it.

I'm not sure you can sue, it sounds like an accident. Do you really think they were negligent? What costs would you be suing to have reimbursed?

Sounds ghastly for you and DC but I think talk of suing is OTT.

I don't know about sueing ,but I do hope that the accident was recorded in the accident book/ record, especially as treatment was required.

what are you suing them for? having furniture?

The hotel have done nothing wrong.

What did she trip on though. Did she slip on a wet floor or a very polished floor?

TBH is she just tripped and fell I can't see how the hotel is negligent.
I can see what you mean about sharp edges on tables but to be honest I don't see many hotels with the children corner table protectors on them.

hmmm difficult one.

Your child slipped and injury himself accidentally and you want to sue?!?! For real?!?

Even asking the to 'baby proof' their lobby is over the top.

I'm sorry your child was so badly hurt, but honestly!

your toddler (who i assume is barely walking and therefore unsteady on his/her feet) fell and unfortunately hurt themselves and you think it's in some way the hotel's fault for not babyproofing?

I am sorry that your child was hurt, but why on earth sue? Other than for money which is not going to help anything. Kids trip and have accidents,

13 month olds fall ALL THE TIME - and it is YOUR job as parent to try to anticipate and prevent that

sorry your baby was hurt but your are SOOO BU talking about sueing them - they did nothing wrong!

if it was a wet floor, a broken tile etc, thats a whole different story

It sounds like an awful accident, not negligence. How on earth will you sue them for that?

The h6tel considers themselves to be child friendly, they have re-modernized the lounge and its not child friendly at all.

I dont want to sue, NO, however I do not want a toddler to injury themselves again with the sharpness of the corners, he tripped over the chair leg, and then onto the table corner.

As Ive said, it was a accident, however I feel they need to take measures to prevent this from happening again.

Sounds like a horrible accident, your poor child.

However, what would you be suing the hotel for? Confused Accidents happen.

what did the hotel do that caused the accident? if they were at fault then sue but i am afraid you are coming across as being part of the claim culture.

Of course you shouldn't sue, and if you do I hope you don't win. The world has gone mad when hotels have to baby-proof every bit of furniture in public areas. Next time hold your baby's hand so he doesn't trip and hurt himself.

It's totally unreasonable to expect hotels to child/baby proof their lobbies.

If the hotel welcomes children then it's entitled to call itself 'child friendly' - that doesn't mean no child is ever going to slip over or hurt themselves on their premises.

Yes on the small ones, they already have safe guards on the large ones, however the new tables dont have.

It was a horrible accident, but it was just that..an accident.

Children fall and hurt themselves all the time.

You can't expect every home/shop/hotel/public building to have padded furniture, corner protectors or safety guards on every potentially dangerous object (especially as any item can be potentially dangerous to some children !).

Call Health and Safety. If they deem it an accident then there is nothing you can do (other than name and shame). If they don't deem it an accident, and it is negligence on their part then, yes, take action!

Am sorry your dc had this accident but agree with otters that in absence of unusual circs (eg wet floor) the hotel is not negligent. In fact if you do decide to sue what more do you hope to get out of it and is it likely to outweigh cost and hassle ? Also if you turn this round and look at what hotel lawyers may say as parents you were being irresponsible to Allow young unsteady child to walk about near a hazard (this kind of horrible accident all too common therefore you should have been more careful).

I think best you can hope is for hotel to get staff to warn people with young kids to be careful.
